Some muppet ran into the back of me while I was stationary at an island yesterday - anyway, I woke up this morning and my neck feels really stiff and my back hurts so Im failry certain i have whiplash...

...have no idea about how to claim compensation - do I use a specialist or should my insurance company do the legwork for me?

Anyone have anything similar happen to them?

What financial loss have you suffered so far as a result of injuries sustained in this accident?

It is interesting that in the 2 hours and 40 minutes since waking up and discovernig this you've already decided your life has suffered sufficient hardship to claim thousands of pounds in 'whippy compo mate'.

when I had a claim back in 2003 mine was all done through the insurance company, didn't bother with any other company, they sorted it all out, made an appointment for me to see a doctor and everything.

Currently looking for work and it has definately hindered my job seeking abilities... other than that, none really!

I find it quite an interesting moral grey area, where would you draw the line at what you can claim compensation for? I agree there are a lot of ridiculous instances of blame = claim, especially when the claimant is really at fault. However if you were maliciously attacked or injured as a result of someone elses direct actions (e.g. crashing into you) then why should you not be compensated for the pain etc you have been caused.
Whiplash is a condition that can last for years and could easily have byproducts like not being able to sleep, I'd say there's the potential for it being quite disruptive even if the actual pain involved is pretty mild.
Should you really only be compensated for financial loss?

yup. had to make a claim years ago after getting nailed by a car turning across my path at a junction. used a specialist personal injury lawyer.

took awhile to resolve, about 14 - 16 months iirc?. claimed for every thing, even my clothes ( ambulance crew cut me clothes off dammit ). didn't cost me a penny, the other drivers insurance company payed all legal costs when the case was eventually settled.

You are barely 2 hours into the working day and you already know it's definately hindered you?

You have up to 3 years to claim. In a years time when its apparant there are lasting problems, perhaps it would be right to claim. But hours after waking up with a stiff neck? You've got a stiff neck, get over it!

We can't always blame everyone for everything else, there has to be an element of accepting risk. Driving cars is dangerous. 'Compensation' is there to reimburse you for losses - ie if you are involved in an accident, lose a leg, and cannot work for 6 months then damn right you should claim.

This guy has been awake barely 2 hours and already he knows its WHIPPY COMPO TIME.

I wouldnt give a ***** but its our inflated insurance premiums that pay for this stuff not the negligent third party anyway...

Nothing is going to change the stupid prices we pay, as everyone will continue to claim for things like this.

He will still have to pay the high insurance regardless of if he claims for this or not, damned if you do damned if you don't.

May aswell follow the flock to an easy 1k.

I do agree that the morning after is either time to claim for major injury or not the time to claim at all. Especially as whiplash usually presents a few days after the incident itself.

I think there is a reasonable element in the "you physically hurt me, I'd like something in return" though, obviously it's something that's easy to take advantage of especially with something like whiplash which can only be judged on what you say is wrong

I received 1.5k and for just mentioning I felt a bit achey the day after I was hit from behind whilst staionary.

So glad I did as when I came to sell my car I had to drop the price as the repair work was so obvious (new panels, welds etc.) it put people off. So the compensation made up for my loses as far as I was concerned.

I had whiplash, shoulder trauma, vertebrae damage and back pains from my motorway fun, and the police and insurance companies have found that it was the Mazda RX7's fault. I've had so many calls from lawyers reckoning I could get £20-30,000 if I really pushed it.

Have instructed my insurance company to get the cost of Chiropractors and my glasses (which had to be replaced) back, nothing more. Not entitled to any more. These lawyers are so bloody irritating.
