Bought An Gigabyte 8800GT 18months ago and OcUK are not honouring their warranty and want me to contact Gigabyte. It clearly stated at the time of purchase : "Two year warranty with OcUK".

Would I buy from OcUK again?
 
I too have a 2yr premium warranty with Ocuk so this is a little worrying. However I'm sure it will be a misunderstanding and if correct Ocuk will come good. They have an awesome customer service reputation and usually someone will 'chip in' shortly and put this right. Assume you've phoned them and got the 'wrong person'. Pity you've had to post on here about it.

I've emailed them twice and they won't budge. Gigabyte want to charge £10 + postage to repair/replace card.
 
Just got a reply from Gigabyte Returns Dept:

"Your Cheque/Postal order for £10 inc. VAT should be made payable to: GBT Tech Co Ltd and must be sent with your RMA item. This fee is NOT a charge for repair as this is done free of charge under warranty. If you prefer to send cash, this is accepted but please use Registered post when sending your item in case of any compensation claim. To avoid any fee, you have the option of returning it back through your supplier who should accept your item. If they refuse, please ask for any name or forward any e mail contact that you may have had with them to: [email protected]."
 
Thats odd - the usual done thing is you pay postage out, they pay postage to send back... not sure if theres any regulations about that tho.
 
I'm not sure if this is current law... but under the sale of goods act:

If the buyer requires the seller to repair or replace the goods, the seller must—
(a)repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the buyer;
(b)bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).

EDIT: Not sure if this applies to the manufacturer as they aren't the seller

I'm sure theres people better qualified to advise on this aspect tho.

Also by the looks of it in this case for upto 2 years the seller should handle the replacement - tho you can opt yourself to go via the manufacturer... tho again I'm not an expert on this.

That would be correct.

Why overclockers are reluctant to do anything, I'm not quite sure, as really, all they would do is replace the customer's card, then send the broken card back to Gigabyte themselves for a repair/refund/replacement to replenish stock.

Thats very poor service from Ocuk to be honest and I'm more than a little worried their 'Halo' is slipping. Unlike you I have proof of the 2yr 'Premium service with Ocuk' as I printed off the page from the website when I made my purchase. They are still selling Xfx cards with this premium warranty even now. They are bound by law to honour this warranty! Come on Ocuk this is not like you and a little disturbing.:(
