Had a crash...

Hey, cheers for the replies. The guys dad had phoned me (doing his dirty work i guess...) and he was trying to put blame on me saying I was undertaking and hit the rear of his son and so the insurance would take his side. He even started quoting me the highway code, felt the need to quote back saying that his son was in the outside lade behind traffic with my lane clear, hence highway code says I'm ALLOWED to pass on the left. He still wouldn't listen.

Load of tosh but hey ho the guy is only a named driver for that car - its his dads policy - and I have my doubt that the dad actually uses this beat up old 206 as his daily rather then his student son but never mind that's a different story!!!

Now that I've had time to think about it I have to agree with some of the comments above and that going through insurance for a dented wing on an X reg mondeo is a bit silly and a waste of money in the long run - any ideas roughly how much it would cost to get a new wing fitted? I wouldn't normally bother since the car has a broken rear bumper and a couple of dents in the doors (parking retards) but this one is down to the metal so dont want it to rot!

Any other (cheaper) ways to fix a dent with the paint flaking rather than replacing the wing?

Are you supposed to stop immediately and put your hazards on after a small bump? He might have been trying to find a quiet place to pull up instead of holding everybody up.
 
looks like a bit of a 50/50 to be honest...

you were behind them at the lights so you were undertaking them when the accident happened.. and possibly in the other vehicles blind spot so they might not have seen you..

they weren't blameless though. they took the wrong lane from the lights and didn't indicate..

No, he wasn't undertaking because he didn't change lanes. He was overtaking on the left.
 
And let's not forget that the other guy (who it sounds like may be fronted by his dad) was weaving in and out of lanes without indicating and without good reason.

Did he even overtake him though? All I can read from the OP is he pulled up alongside of the car in the lane next to him. Is this classed as overtaking too ?

I've been taught by my instructor that the person who makes a special maneuver ( like changing lanes) is ALWAYS in the fault in case of an accident as the person minding his own business in his own lane has the right of way.

But from what I'm reading in the OP, some young idiot forgot to check his dead angle and then changed lanes, didn't respond to honking and continued to cut the OP up.

Undertaking is allowed if the other lane is going slower.

This will go 50/50 for sure.

I can't believe the OP had time to press the horn :confused: These sort of things happen so fast.
 
If it is student digs then put flyers through the doors asking for any witnesses with a small reward possibly?

OK, he was in the process of overtaking :p he started from behind the other car, and accelerated forward so he was nearly beside the other car. He's essentially started the manoeuvre, whether or not he's going to complete it.

Nope, undertaking is being in someone's lane behind someone, pulling into the left-hand lane, overtaking in that lane, and pulling back into the original lane - it's a manoeuvre requiring two specific lane changes. Overtaking is just that - overtaking - where no lane changes are required, and it doesn't matter which lane you're in.

No undertaking is what a funeral director does, there is no such thing as undertaking on the roads (unless you count hearses). :p

Its overtaking on the left, this is not illegal and you can do this at any time.
