Homeowner fights off knife-wielding burglars, gets 30 months; burglar spared jail

Brain damage wasn't enough for that scumbag. We have loads of retards like that round where i live. The sooner they are all wiped out the better.
 
I wonder sometimes were the British mentality has gone, its got worst over the years, now we have people saying its ok to beat someone running down the street. Its all kill kill kill stab stab. The media is making it so much worst.

I would say 99% of British people would not give chase.

If you manage to keep your emotions under control, then the only sensible decision to back off and hope the crims don't hurt you too badly, anything else and the authorities will be out to get you. Personally I'm not sure I could keep my emotions in check if my wife and kids had been tied up and threatened.

I dont think the major crime committed by the burglar was the attempted robbery. The major crime was when he tied up the family and then threatened their lives. This is morally, very serious.

I'm not married, but if my wife and kids had been tied up when I arrived home and the burglar was still there, one of us is going to die or get seriously battered. Plain and simple.

A lot of people on this forum think that Mr Husain would've been thinking in a calm and coherent manner. The moment he knew his wife and kids had been tied up, he would would've been in enraged, to the point where nothing else matters to him, apart from destroying the burglar.

Notice the word 'destroy' - not kill or harm, but destroy. This would account for the cricket bat breaking. If he just wanted to kill or harm the burglar then he would've been able to achieve this without breaking the bat and using the metal pole would've been able to kill the burglar with ease.

I, for one, totally sympathise with what Mr Husain did. I'm not saying it's right, but I would've probably done exactly the same thing, upon finding my wife and kids tied up.

Slightly interesting bit of information regarding the case.

Apparently the self defence, defence was never even tried.
The defence against the charges was "I was not involved".

So even the guys involved knew they weren't going to be able to use self defence in their favour, but would rather try the "I dun nothing guv" option despite witnesses.

Which points to their defence lawyer either being absolutely useless, ignored, or knew that they didn't have a chance with a self defence plea, even allowing for the fact that Juries are loathe to convict anyone for attacking someone who has broken in to their home..
 
But he knew they were safe, running off after someone is good to nobody, hes left his wife and children, he should be at their side comforting them, running down the street like a lone is helping nobody.
 
You guys have made some very good points, the main one being that if you get home and find your wife and kids tied up by a knife wielding maniac then its hard to assign logic to ones actions.
Anyone here with a wife and or kids would, or more importantly should do the same. In that situation the time for reasonable behaviour is well gone. You simply wouldn't consider the concequences. If the justice system in this country is so pro criminal (which it often appears to be) then maybe its time we all started burgling peoples homes for a living.

The Law is the same at all times in regards to self defence or the defence of others, it's always been what a reasonable person might consider reasonable force under the circumstances.
That includes everything from whacking someone once with your fist, to grabbing a knife/bit of wood/harpoon when attacked.

What it's never included is chasing someone down, continuing to hit them once they are down and unconscious, or shooting them in the back as they are fleeing.
There is a huge amount of leeway for the person claiming self defence (especially in the home), and it takes someone really going overboard for a Jury to convict when charges are bought against the person (the Jury will pretty much default to siding with the defendant in such cases, as they'll normally think about how they themselves might react).

Even the police operate under the same basic law when it comes to protecting people (or themselves) from threats.

Once he discovered what had happened, he would've been overtaken by rage and would not have thought that he should be with his wife and kids. All he knew that the guy who tied up his wife and kids was making a run for it and that he had to destroy that man.

And? it is mitigating circumstances that the court considered. Hence why he only got 30months.

He also did not plead guilty and said he didn't do anything. He is lucky to only get 30months. Just because you see red does not mean you get of scot free.

In which case he was patently acting beyond reasonable self defence.
