Remember to always do the right thing and say Sorry....

Which is why no assumption should be made either way. Which is why I asked, if it turns out that his upbringing was fine, would a 3 year term in a young offenders institute then be a suitable punishment?

I doubt any of us would be qualified to make that sort of judgement, but if the kid is unable to be rehabilitated, how would a longer stint in jail fix anything?

When he gets out, he'll probably commit shizzle again.

To those citing death, would you be so quick if it were one of your kids that did this, regardless of how well you brought them up?

So I ask you again, what would you do in the situation?

So what would your solution be? Or are you suggesting that no rapist should ever get a longer term than 3 years, regardless of situation?

Why am I supposed to have a solution?

I was just backing Vesta about there usually being more to these kinds of situations than what the public hear and form opinions on.

Because I am curious to know what you think is an acceptable form of punishment for a rapist. It is after all a discussion :)

I have no idea, as there are many intricacies that I'm not privy to about law, and cases like this. I couldn't really make any sort of decision on it.

However, younger offenders stand a greater chance of rehabilitation compared to adults, so I'd rather see money and effort pumped in to saving these sorts of kids before they go this far, rather than just waiting for **** to hit the fan and then spending the same money on incarceration.

So to give you a specific example, a 23 year old man rapes an 8 year old boy. The 23 year old man has had an ordinary run of the mill upbringing and lives in an average suburban area.

What sort of punishment do you think would be suitable for said crime?

3 Years?
15 years?
Death?
Put away for an unspecified amount of time until deemed fit for society again (whether thats a brief amount of time or a long period of time).

Just trying to get a sense of exactly what it is you think warrants what sort of punishment.

I. Don't. Know.

I'm not in a position to dole out punishments.

In fact, the only stance I really have is a yes to the death penalty in VERY specific circumstances:

a) It is without a shadow of a doubt that the person is guilty of the act. No chance for evidence tampering or people getting it wrong.
b) It was not a heat of the moment/self defence type thing, only premeditated or unprovoked.

The problem with even this is things like war, which could be arguably self defence/heat of the moment, but then leans to it being based on the killer going in, or protecting their own.

Overall, crime and punishment is all far too grey for me, I like black and white (probably why I'm in to computing), and is why I never got in to law.

So by your specific circumstances (a and b). You would say death?

You can't just say someone who rapes gets X Y Z!
Each case is thoroughly different with hundreds if not thousands of variables and therefore should be addressed & punished accordingly, imho.

Harsher punishments would have an insignificant effect on reducing crimes of this nature (practically all the studies into this compounds this), spending more money on rehabilitation, social services, peer mentoring, youth work ...etc ..etc WOULD have a significant effect imho.

sorry, don't care what people say about rehabilitation or deterrence, some things should be punished severely. this is one of them
3 years is nothing, not in comparison to the victim
this is plain wrong.

In 3 years he will be the same scumbag he is now, just bigger.I would hazard a guess that we will be reading about him again in 3-4 years, when he does it to someone else.
