So you guys have never got say a few tops from an online shop, got them and either not liked them or they have not fitted and just kept them anyway because it's morally incorrect? :confused:

The diff is you didnt buy them with the intention of using them and then returning them. If the OP is saying he will keep it if he likes it then thats diff but going by the OP words, this is NOT the case

As stated, it is not the law. What was posted is a guide, but guides aren't used in court.


Here's part of the actual law, see your own link for details.

Sect 17

(2) The consumer shall be treated as having been under a duty throughout the period prior to cancellation—
(a) to retain possession of the goods, and
(b) to take reasonable care of them.
(3) On cancellation, the consumer shall be under a duty to restore the goods to the supplier in accordance with this regulation, and in the meanwhile to retain possession of the goods and take reasonable care of them.

If the product can no longer be sold on, you have failed to take reasonable care of it.

To remove the packaging, and then "test" it out for a days and then give it back. Yes, morally wrong. Not to mention they would usually say no if it was sealed anyway.

Yep, and there's nothing wrong with that. However if you purchase something online, there are the costs of postage to consider. If it costs them £5 every time you ask to open one of the products in the store, they'd be more likely to say no.
 
Hmmm wonder how much stuff we buy online is not quite as new and unused as we think...
I think getting it just to try,with absolutely no intention of buying it,is taking the P somewhat.
 
Why do you want return it before you have even tried it OP?
You can do that, but whats the point? You're just abusing a system thats put in place to protect consumers.

The fact that the OP can maybe get away with this is not why the law was introduced. The law was introduced to protect agaist misselling mostly which this is clearly not.
If the OP is wanting to try one out he should get off his lazy arse and go into town to check one out in a shop instead of costing the rest of us money by defrauding an online seller. These costs will be recovered from somewhere, i.e me and all the other honest buyers..

And how someone can be so stupid as to come onto an online sellers site and ask about doing an online seller out of some cash is beyond me. :rolleyes:
 
Legally it's fine you have unconditional right to return it within the cooling off period, it's fairly unethical though if you have no intention of keeping it as the act isn't there so that you can borrow and test things.

The "problem" here is not a legal one, its a moral one...

Anyone that says buying things to try them/use them with no intention of keeping it and sending them back is fine really needs to check their moral compass IMHO...

I merely linked exactly as stated. There are a lot of people who think that this is perfectly fine. Overclockers B-Grade stock is exactly that. Opened items, returned, warranty claims etc.
