Car Insurance Claim - Scam?

Hi there,

My girlfriend has been contacted by her car insurance company saying that she reversed into someone at 10mph and drove off causing a claim of £900. She knows nothing about this and the car was over 20 miles away from the alledged indicent on the alleged date. She has told the car insurance company this but they say they either accept the claim or it goes to court.

What makes it worse, allegedly there was an off duty police officer at the scene who gave his ID and wrote a statement, so she hasn't got a leg to stand on. Now she stands to lose 3 years of her no claims bonus.

Could it be a scam? Does she just take it on the chin or is there anything else she can do to dispute the claim?

surely if its a cloned plate its on a RED ESCROT and her Car is a BLUE POLO thats all you need right there?? if not then fail i guess you are screwed.

if its free to go to court then do it for the lols, as long as when you probably lose you dont have to pay the fees.

Can she not prove she was 20 miles away at the time i.e. if at work, have the support of her colleagues etc.
 
Ask for a copy of the statement from the officer.

It should detail what make of car, colour etc.

If it matches up, then your missus clearly reversed into someone at 10mph and drove off causing a claim of £900. ;)
 
she was xmas shopping at the time with me, and yes I paid for everything so she has little or no evidence.

the cars description also matches the one of the one involved in the incident.

oh and if she reversed into someone at 10mph surely there would be some damage to her car?

Did she drive when u went xmas shopping as surely there would be cameras that would have recorded it somewhere
 
Perhaps her car was taken for a bit of a spin by some joyriders and left off again? :p

That actually happened to our family once. Were none the wiser that it had even been gone overnight until the steering wheel came off in my mum's hand halfway down the hill from our house!

As someone has said already, if she did that much damage surely there would be damage to her car too and I would have thought it would be quite easy to tell if it had been repaired recently?

That makes it better, not worse. If a police office was called to the scene of an accident and took a statement surely he would have asked for a drivers license, and copy of certificate of motor insurance, as well as wrote down a description of the person that was supposedly driving your car.

I was stopped under Section 44 Terrorist Act last night as it happens, and the nice lady officer took all my details down and a description of me on her wee incident report, and handed me a copy, if for example your girl is white and the officer at the scene was talking to a person of another race and its on the report, or if the other details don't match that of your girlfriend, then some manner of fraud has occurred and its your insurance companies problem.

If you were xmas shopping at the time there's a fair chance you were both on shops cctv at around the time of the incident meaning there was no way that it could be her. May be worth checking out if you can.
 
I used to work in a solicitors in the claims department and dealt with a lot of motor insurance claims. Now I'm not legally minded but experience has taught me some things. Request a copy of the report taken by the policemen, you can also be a witness that your girlfriend was with you at the time of said incident. Also try and retrace your steps and look for viable CCTV footage of you with your girlfriend at the time of the incident providing evidence she wasn't in the car at the time. Were there any other people that you met on your shopping trip? Friends, work colleagues? If so then they too are viable witnesses. The last thing to do is to go to the location where the incident happened and locate any further CCTV which could show the vehicle that was involved at the time of the incident. I had cases where people asked us to check their car for damage and to prove that here was no work done, however they wouldn't allow us to do that as the insurance company said 'It could be a different car and there is no evidence of it being the same one.'
She does stand a good chance. However it's just trying to prove that she wasn't in the car at the time of the incident, it's not really about the car being involved. It's a bit like speed cameras. If you get a ticket saying you were speeding and caught on camera you can protest against it saying that you weren't in the car at the time and provide evidence that it can't of been possible.
