Im in the process of buying my first house. The mortgage is approved, the house has been valued and its all with the solicitors at the moment. The only problem is that the estate agent has not removed the house from the market. I dont mean taken it off completly, they just have not listed it has being sold subject to contract. Now other houses they are selling are being listed as sold but not mine. I have asked them twice over the last 10 days, they have promised to do so but nothing. Its pi$$ing me off now. Any suggestions guys or am I over reacting?
 
I believe that the estate agent's code of conduct is that once a bid is accepted they must (should) stop advertising it. I could well be wrong.

I think you're right to be suspicious, the agent is probably being driven by the seller though.
 
Call the estate agent. Tell them that you've asked them repeatedly to take the property off the market, and if they don't do so right now you will withdraw your offer.

If the person you're talking to says they can't do that right now, tell them you wish to withdraw your offer and you'd like to speak to someone who can process that for you. They'll have it off the market in minutes.

Then you can spend the next 10 years wishing you'd never bought the place. :p

Have the solicitors exchanged contracts yet? If so, the gaff is yours unless the seller wants to pay penalties if they gazump you.

If you've not exchanged then as others say, threaten to walk.
 
I assume the OP doesn't live in Scotland???

Was going to ask that too mate, it'd obviously have quite an impact on the situation.

OP - Don't stress too much but you should speak to your solicitor and ensure that it's made clear to the seller and estate agent that you will walk away if they don't remove it from the market ASAP.
 
nope, not from jockland.

The mrs has called them today as I have been tied up with work, they said they would look into it and call them back (yes shes a bit soft) Guess what, just checked and it still unchanged!!!!!!

If you've had a letter from the Estate Agents saying the owners have accepted your offer then the house is yours (subject to contract)

Christ if you're getting stressed now I'd hate to imagine what you'll be like at the end of it all :p
 
I have not personally had a letter from the estate agents, im assuming my solicitor has. Well he told me they have recieved the paperwork, have also recieved paperwork confirming the mine check is ok.

It matters as it says to me they are trying to get a better offer. Also that they have lied to me three times now.
 
Do as others said and threaten to walk if they don't solve it. Them saying they would "Look into it" makes it seem even more dodgy.

Such a stupid thing to end up having to worry about. Hope you get it sorted.

Nope it isnt. In England there's no legal obligation until exchange.

Do as has been said, either it's taken off the market or you walk.
