Cherie Blair to fail as hard as hubby, it would seem. :D

A senior judge could be called on to investigate a complaint that Cherie Blair handed down a more lenient sentence to a man who had been convicted of fracturing a person’s jaw because he was religious.

Mrs Blair, a devout Roman Catholic who sits as a part time judge under the title Cherie Booth QC, spared Shamso Miah from jail last month after he was convicted of assaulting a person at a bank queue in east London.

The 25-year-old from Redbridge, north-east London, was given a two-year suspended sentence instead of a six-month jail term because, Mrs Blair said, he was a “religious person” who had not been in trouble before.

I'd have thought that Mr Miah having no previous offences recorded against him would be more relevant since his religious persuasion apparently had no effect on breaking someone elses jaw. However we don't know the full circumstances that caused him to assault the other man nor whether he has undertaken any form of reparations/voluntary punishment for his crime as part of his church - if this was the case then his religion could have a bearing on the punishments appropriate.
 
The judgement as reported is:

Cherie Booth QC said:
“I am going to suspend this sentence for the period of two years based on the fact you are a religious person and have not been in trouble before,” she said. “You caused a mild fracture to the jaw of a member of the public standing in a queue at Lloyds Bank. You are a religious man and you know this is not acceptable behaviour.”

I guess what matters is if the suspended sentence was due to the fact he had not been in trouble before or if he had not been in trouble before AND he was a religious man. If the latter then it is definately an issue and could be seen as discriminatory against someone without firm religous views.

Despite being agnostic I can still work out that breaking someone's jaw is not acceptable behaviour...
 
We don't have the full facts, personally I find it more annoying that she's brought religion into the court room when it had absolutely no reason to be there. I'd like to point out that the suicide bombers are religious men too.

Dippy cow, she could have avoided the whole thing by simply giving another reason for letting him off lightly.

Can you request a different judge if you claim to have a personal grievance with the one you're landed with?
 
Now I know to play the religion card whenever I get in trouble. This is pathetic.

I wonder what his sentence would have been if he was an atheist?

I agree with the secular society in this case, outrageous justification for the decision by Cherie Booth.

I think she will soon find herself persona non grata if she doesn't start thinking before speaking. ;)
