Motorway Lane Priority Question...

The way I see it is if they are in lane 1 and I'm in lane 3 then theoretically I should be overtaking them therefore going faster than them, so if they move into lane 2 first I can then move in in front of them once I've overtaken.

By allowing them to move it dos not hinder either of you in any way, however if you move across first, you stop them from starting their maneuver, therefore hindering them, or you end up having to slow right down to allow them in front of you therefore hindering yourself.

So to smmarise, allow them to move into lane 2, overtake them then move into lane 2 yourself this stop you from hindering anyone including yourself.

This. unless you drive a bmw and then you wouldn't move from lane 3 unless you are pulling off the motorway and are past the 100 yard marker for the exit you need ;)
 
I would have thought that it should be treated as a "wide" overtake. Ie, if found in this situation the person in lane 3 should clear the person in lane 1, before moving back to lane 1 themselves. This removes any chance of a collision as the person in lane 1 can do what they please.

Thats my take on it anyway, as a very heavy motorway user.

Im guessing it would be a 50% 50% if insurance companies got involved, both drivers should have been aware of each others presence and not move out.

If it were me in car 3 though I'd probably anticipate the person in lane 1 moving into lane two based on the speed of the car in front of the lane one car and subsequently not manoeuvre until past both vehicles.
 
Have been in the situation and always pressed on till I cleared them. I am the faster moving car, it's easier for me to stay put and clear or slow down and yield (if I want lane 1)

I don't care what the law says on the matter, it's a common sense thing.

I was in a "tricky" situation when driving up to a work meeting the other week actually. I was cruising in the slow lane behind a lorry, required the middle lane for M40/M42 road split, I indicated for about 2 seconds and checked the lane was clear as you do in autopilot mode when motorway driving. I then started making my manoeuvre into the middle lane, when somebody going much faster in the lane 3 (outside lane) pulled into lane 2 on collision course with me as he wanted to take the exit off lane 1.

We both saw each other and parted before hitting, but needless to say...it shook me up as I was following all the normal safe procedures for changing lanes and he seemed to come out of nowhere trying to get off at the exit (moving from lane 3 to an exit on lane 1). I take it that I was in the right and he was in the wrong? or would it be 50/50? He must have been going faster than the specs speed limit shown too.

I drive a Saxo and can combine the two above. People on the road seem to hate Saxos. Ill be overtaken just so the person /can/ overtake me, then sit in front of me and slow down, so I have to overtake again....

Anyway, coming up to overtake some cars in the outside lane, not quite there yet but road seems clear behind me... till Mr Beemer appears doing god knows what demanding I move. You dont realise how intimidating it is in a tiny hatch for a X5 to plant itself a few feet from your bumper. So you think, I'll move and let the **** past, only for some other impatient nutjob coming up on the middle lane to undertake you and dive into the gap thats still left, while you were about to move over.

This is while driving to the speedlimit.....

This is why I much prefer driving a large intimidating car with a large intimidating engine than a small tin box ...which I have done in the past, so I know what it's like. I commuted 5 days a week 72 miles a day in a 1995 Ford Fiesta for a while, that was ...well horrible, but it was my first car so it didn't seem so bad then.

I was cruising back home today on the M6 westbound section between the M1 and the M42, I wasn't going that fast, just an easy cruise but I was in the outside lane passing all the slower traffic at this point, short time goes by ...and of course an A4 is up my rear with his LED’s glaring at me for daring to be there in my 10 year old piece of tat ...well anyway, I flexed my right foot to see what kind of ‘overtaking’ power the 540 has, all I can say is, if cars could look embarrassed and humiliated ...that one did, so a little later after I had let him know my peni.. err engine is much bigger than his he passed me and sure enough it was a 2.0 diesel as you might expect :D

Audis, pahh.
 
Give way to the right, it's the guy in lane 3 has priority.

However, the bloke in lane 3 should be in lane 2, and the bloke in lane one should be staying there.
