Well back home now and I got the ladies details and will try and do as dogbreath suggested and claim direct from the third party. She came back to car I got out mine and as she looked at me she started shaking and then began crying before I even said anything. It was a middle-aged lady and she then began sobbing and saying she paniced and was so sorry. I took her details and will try and claim direct if she doesn't want to pay I will just leave it. No point in claiming of insurance will only raise my premium. I didn't report to police either as can't be bothered with the hassle. I know this isn't the right thing to do but if we look at it from a different angle she could argue that she planned to come back and leave details and the law does state that she has to pass on the details in a reasonable time.
thoughts and opinions welcome but i think i took best course of action or maybe i just wussed out cus it was a crying little women and i'm a big strong man lol.
