Bailiffs - Oh Ow!

As stated above, unless the Baliffs have a Court Order, then they cannot enter the premises without your permission. Most DCA's use the threat of Baliffs as a scare tactic.
 
Bailiffs needs to ask permission to enter the premises, the amount of warrants that used to get returned to the court from insurance claims was unbelievable.

or your friend can offer the court to make repayments as little as 5 per month!!!! what a joke.

This is a little bit of an urban myth - but one that is still nice and alive on forums such as this.

Your friend can indeed offer to "pay 5p per month" but there is no way that they will accept this offer.
For some reason there seems to be this myth that any offer will be accepted.
The courts will ask you to provide proof of income and outgoings and then an acceptable amount will be decided upon.
It's certainly not "ball in the defendents court" with regards repayment schedules.
 
are u sure these are bailiffs and not debt collectors, there is a big difference, and in any case they have no right of entry so lie to them and say he doesnt live here or tell them to **** off either way they will get bored and go away
 
A proper bailiff is court appointed and acts after a county court judgement has been granted by a judge typically.

A bailiff can enter your premises without your permission but ONLY if they can get in without damaging anything i.e. they cannot force entry at all - unless a judge re-looks at rhe case and decides that forceful entry is permitted.

a debt collection agency has no legal powers at all. they get their money by acting menacing and anoying - you can send a letter to said companies and get them to leave you alone. if everyone knew the law debt collection compniaes would be out of business.
 
thanks for all the advice guys, read it all but will go over it again in more detail ^ also thanks for the link, think i'll phone around a few places and try to get a professional opinion aswell as it all sounds very cloudy!

The debts not with the goverment its creditcards and the like. Also I wont get into why he has the debt but its not really his fault so dont cast to harder shadow on him as everyone can fall unexpectedly on badtimes

Actually it isn't an urban myth - my ex wife dumped an 11k debt onto me, we did both sign for it and I contested that she should pay half but because she couldn't be found I was found accountable.
It eventually went to court and I offered £1 per month which was agreed as I had recently lost my job due to illness, it has, admittedly, totally screwed my credit rating although I'm not too bothered about that to be honest.
I've been paying £1 a month for the last 5 years and I won't pay a penny more until they admit that I should only pay half of it, whether they can find out where she lives or not. Bloody cheek.
With normal debt collectors though (not CCJ's) if you just pay what you can afford into their account every month then they cannot take you to court for more.

Slap your mate for being such a monumental idiot in getting into 30k debt which he can't pay.

Label your stuff with UV ink, if the baliff wants proof it was yours shine the UV light onto it.

don't even need to do this tbh.. - just don't let them into the house... its that simple

they're not police trying to arrest you, they've got next to no powers - they're just hired goons who attempt to recover goods by intimidating you or hoping you're naive enough to believe you have to let them in.

If they keep pestering you then you can sue them for harassment too IIRC.

Get your mate to do something about it though sort an IVA out with the creditors perhaps but don't take any notice if some fat numpty with a shaved head turns up on your door - don't even open the door to them - if you let them in even 'for a chat' etc.. then they can start removing stuff.
 
That's rather judgemental. You have no idea why he has debt or reasons for the bailiff.

Hardly judgemental. It takes a fair amount of effort to become £30,000 in debt without including a mortgage. In unusual cases you may be correct, but in general, you're not.
