Essentially, i was coming down a road (whitehart lane) when a girl ran from the sidewalk right into my side mirror and destroyed both it and cracked my windscreen. I was doing about 28-29mph on needle and my back wheel must've rolled over her leg breaking it. Police, ambulance etc.. came and took witness statements, she was even screaming "it was my fault" and all witnesses agreed she ran out from behind a parked X5 and basically into the side of my car. Police kept me there, saying if it was a life changing accident they might have to take my car, breath tested me etc.. came up clean obviously.. until the news came that all she had was a broken leg. The police even reckoned i should hear nothing more of it cause she even admitted to it, with all the witnesses etc.. Spoke to my insurer (Elephant) who reckons i can lose 3yrs no claims if she does claim. What are the odds of this and can i dispute if she does? I'm well shaken up and jut glad shes ok at the end of the day, but still worried about whats coming up.
 
With all the witness statements, police involved, then I doubt anything would go in her favour. No doubt they will try though!

You need independant witness's who are willing to give a written statement, without this you will have problems
 
Everything was a blur, her parents got my details but i got nothing on her. I have a number and quote number to call if i need help from the police.

I have the details of one fella who says he lives on the road and the police took statements from diferent witnesses if that helps.

Do you know the officer who you spoke to and said that she admitted fault ?

Speak to him / her about this. If she has admitted fault at the scene then this should be appropriately recorded.

Have you been spoken to or interviewed under caution ? Were you given an NIP at the scene ?

No prosecution, was cautioned but not under arrest. I have a quote number and the pcs name and station plus an independant witness who has provided details. They even said everything was a formality as it looked pretty much cut and dry.
 
I really wouldn't sweat on it.

Speaking to you under caution as the driver of the vehicle is standard practice as is breath testing you. It means that alcohol can be eliminated as a possible factor.

Is the lass has admitted fault, you have a independent witness who can back this up and the police advice holds true then I can't see how any claim by her can be held.

I can't see a reason to speak to a solicitor at this time when there is no suggestion that the injured party is making a claim.

If the police were involved then they will have her details. They might not release them to you but they will release them to a solicitor acting in your behalf. You just need the incident ref number.


Edit: Serious reply. Mirror from a scrapyard, windscreen claim on insurance, usually about £70. Cheapest hassle free way to get this fixed.

Alternatively dont waste the 90 seconds of your life it will take. Why would Helphire take it on? There is no third party insurer involved here, nobody to pay the £200 a day car hire charges, etc etc.

I do wonder about some of the 'advice' dispensed on here :/
 
For a man who delights this forum with regular injections of sarcasm and wit, you do appear to have failed to detect sarcasm this time.

The bit underneath that said "serious reply" may have been a clue.
 
I had a child run into the side of my car a few years ago.

Luckily, it was a lower speed, and less damage done to the child.

It did, however, crack my wing mirror, his leg(s) dented my driver's door, and his head dented the windscreen pillar!

Police at the time said that because all the damage was on the side of my car, and not the front, it was totally clear-cut that it's not my fault (plus the witnesses around said he just ran out into the side of the car)

Heard nothing more, but when I claimed on the insurance, obviously I'd lost NCB because there was no 3rd party to claim from.

Looks like the mirror is fine. The glass just popped back in when i pushed it, could swear some of the plastic bit inside came off on the scene though, did a few karate chops on the cover to see it it'd fall out back but seems fine.
