My dad has time to book off as part of his annual holiday entitlement unfortunately the company he works for have said he is not allowed to take it over weekends and (much to his anger) refused easter monday. He is contracted to work every weekend but surely he must be legally allowed to use his holidays when it suits him? If this is indeed the case can anyone help point me towards some evidence to show his boss.

if he is only just trying to book them i have no sympathy. Don't think there is any legal standing on when you can take holidays others shops and most other buisness's could not get away with the no holidays over christmas rule

It's upto the company to make sure he gets all his holiday. But he has no say as to when they are and they can be refused by the company.

They will end up just giving him dates he CAN have off

If it's any weekends then check the contract.
If it's just for Easter Weekend and he is just trying to get time off now, well it's his own fault tbh for leaving it so late.

Companies in general can ask that you give them enough warning before requesting holidays. (Should be something in the contract/employee handbook)

Dates on which leave is taken
15. - (1) A worker may take leave to which he is entitled under regulation 13(1) on such days as he may elect by giving notice to his employer in accordance with paragraph (3), subject to any requirement imposed on him by his employer under paragraph (2).

(2) A worker's employer may require the worker -
(a) to take leave to which the worker is entitled under regulation 13(1); or
(b) not to take such leave, on particular days, by giving notice to the worker

If he just works weekends and his contract is for working weekends then itmakes sense that he should be taking his hols on a weekend. He can hardly be on a weekend only work contract and have to take his hols on a weekday. :p

however, and I get the feeling this may be the case, he is on a normal contract and he has left booking until last minute and is now whining because he now can't get them then that's just tough luck.

Pulling a sicky AFTER they have refused you a holiday is just asking for trouble

Agreed. Sadly there are people in this working world who think sick leave is a second bout of annual leave and make sure they use their allowance every year.

he has only been working there since november and was only just given notice of the number of holidays he has available however his only real problem is my mum is only off weekends so going away anywhere is difficult. The problem with easter monday is that monday is his normal day off and he has just been told he has to work that too. sorry for the confusion.

I hate people like this but the companies i have worked for dont penalise these people so theres no reason for them no to do it.

What is his normal shift pattern?

Also, he's been there 4 months and only now found out how much holiday he has???
