Bumped someone with no insurance, 2 years later they want £7000

Would I been wrong in saying if there was this injury claim, would you all not agree there would have to of been some contact of some sort.
It would seem very wrong for the injured parties insurance company to go ahead with the claim, without say two sides of the story. You would think the police officer at least would be contacted for some sort of report, which in turn this clare would have been notified of the proceedings.
It dont add up to me why is there not a criminal conviction for no insurance or at least some sort of contact regarding the injury claim for the aggrieved

Given what we already know of the conduct of the Ops brothers girlfriend it wouldn't be a huge leap to assume that they had previously contacted her and the issue had been ignored; or the gf had admitted liability in the contact regarding the £400.

Sorry to bring this back up but I wanted to send the op a snippet I'd found but he doesn't have any trust setup, not sure how relevent it is but its about lowspeed impacts and has a few precidents. Drop me an email if you want, address in trust.

The MIB have already paid out though so there's nothing she can do - this all should have been looked into ages ago.

When I said "Stop the bitching", that was supposed to be the last word. Just drop it and debate the topic. If you can't debate nice, don't debate at all. If you carry on this topic will just get a padlock.

Ignore Burnsy, Fox, tell TMR he hasn't got a clue what he's talking about again!! :p ;)

Again? I never told him that in the first place. I've no idea how accurate his advice is - he's almost certainly better qualified to offer it than I am anyway - and my issue a few days back wasn't with his advice but the criticism he made of that other guy.

But do we really need to bring it up again!?

Wow, what a hornets nest I stirred up. MorgUK where are you based? I can suggest a solicitors that specialises in MIB cases if you would like in the Surrey area if that's anywhere near you. As I said previously, not that many solicitors actually specialise in MIB claims because it's a small and relative complex area.

Let's not forget about the interest that will be clocking up - with the possibility of it clocking up on an indemnity basis if you really annoy the court (though unlikely and slightly depending on what was actually written in the letter). As someone already said though - this is not a dispute you want going to court...seriously.

I don't know what I'm talking about and just use Google though, so I'll continue to use my White Book as a fancy paper weight ;)

My MIB knowledge mainly spans from my girlfriend (now a qualified barrister) having worked for a couple of years at one of the few solicitors (as a fee-earning paralegal) that specialises in MIB cases. More generally I rely on my own knowledge of the law - I'm a lawyer of sorts (though some get snobbish about the use of the term) having spent the last few years negotiating intellectual property agreements (against solicitors representing big-pharma and blue-chip companies mainly) in-house for one of the world's highest ranked universities. I've also got two law degrees and am half way through qualifying as a barrister.

Out of interest, just so I know my defence wasn't in vain, what do you do for a living fini?

"The White Book 2009 is the conclusive statement on civil procedure, providing the highest quality of commentary and expert guidance. It offers immediate clarification of complex procedure in the county courts, High Court and Court of Appeal."

haha I know you didn't! I'm a bit surprised you took the bait on that one Fox!

on a random note, i realised a few months after a policy expiring that it was not renewed automatically, even though a letter from the insurer told me it would auto renew.
i queried what would happen in the event of an accident, they said that as they had not received notification to stop the renewal, they were at fault for not auto renewing and would have honoured the policy that should be in place.

might be worth checking if that would be the same for the insurer in this instance, even though it was some time ago now!
