Purchased new game from online store, sent used!

I was reading a post about this only the other day. I'll copy n paste the company's response to a compliant

Guys,

These games are new, however due to demand we have moved some stock back from stores. This stock should be in MINT condition, however it has come to our attention that some ex-display stock has slipped through. This stock is new (it has never been owned by anyone other than us, and certainly it has never been played) however it may have been stripped of its plastic wrapping.

If you have bought a new game from us, then we will have sent a new game to you. If you receive a game that is damaged or you are not happy about its condition then please let us know and we will replace it or refund it, subject to our normal terms and conditions.

The long and the short of it is that we want you to buy with confidence from us. If you're not happy then let us know and we will sort it.

You can return under the DSR - goods not delivered as described. But your best bet is to call the retailer and get an explanation, I'm sure they'll be happy to change it for you :)
 
Had the same issue just before Christmas. I brought a game from one place as new but it turned up used. Actually the game was labelled as coming from Game.co.uk even though I didnt order it from them(they must share the same warehouse for stock). Either way, I dropped them an email, advised to return it back under freepost and it was refunded without any problems.
 
As you are aware, all new Xbox 360 titles are sealed using a standad Microsoft software seal, and not using a company own system such as the one fitted to the receoved game.

That's not the case, lots of supermarkets break the seals to remove the disc and manual. Buying online you'd not expect that though.

Still, I'd certainly be annoyed to recieve a game in the state you have when expecting a new copy. Let us know how they reply.
 
I think this used to happen with Megadrive games because the box was pretty thick and the cartridges wore well. All you would have to do is dust them off. SNES games however came in a very fragile thin cardboard box. Quite hard to pass off as new.

I wont buy games from them either. Once the seal has been broken, there is no way of proving whether that game is new or a return. There is no need for supermarkets to do this any longer. They can either use the insert type security seals, which stops the case from being opened or they can use the crystal security cases. I wont buy new hardware where the item has been unboxed, so why should I buy software ?

Preowned and new game "guts" as we called it in the store I worked in are kept completely seperately.

For what it's worth, Sainsbury's don't do that; customers don't like it and it increases the chances of discs, manuals etc going walkabouts. We either use SWOP cases (dummy cases which we then exchange for the sealed product at the desk), or in the case of cheaper titles, the security safe-cases with the 'live' product inside.

It does not need to be done.

It would not surprise me if GAME / Gameplay do this to allow them to be 'flexible' when reselling used games :(
 
No it is done for security/space reasons. The cases on the shelves that everyone sees are brand new copies, just with the insides removed. There are also 2-3(depending on shop size, bigger shop then more) "fake" boxes on the shelves to fill them, they can be identified by the lack of a bar code on the back of them.

When you bring the empty case up to the desk, they will either give you a sealed copy if they have them or if not, give you the archived insides and then seal it with Games own purple sticker on the side.

They are all completely brand new and untouched other than taking them out of the package. If we did display them on the shelves, then people could just walk out with them easily. You can't put brand new copies on the shelves as there is just not enough room as well.
