Accident blame ( the missus ) - court case 6/4

erm surely the evidence they intended to rely on would have to be disclosed x-days before the hearing? there are some serious questions to be asked here
 
Can you counter-claim based on fraudulent evidence and perversion of the truth?

Oh and get your barrister removed from service due to incompetency?
 
My ex-wife is going through similar, although she wasn't indicating she was just driving down the road when a car pulled out (right turn) and hit her drivers side wing. The ex was in a state :rolleyes: and this let the other and seemingly more savvy woman almost convince her that SHE was in the wrong. 5 weeks laters its still dragging on. Although how the hell she could claim it was my ex's fault god only knows.
Also, to the OP if the other party vehemently deny responsibility and there were no witnesses the insurers may settle on nullifying it, which means you end up claiming for your own car only from your own insurers and thus it affects your no claims bonus. Very nearly happened to me last year but in the end the guy admitted responsibility...phewww!!!

the photo was cropped, my initial drawing of the incident had had the direction of travel changed so it showed Cheryl turning into the car park

even if that were the case the the damage is still on the wrong side, this is just bloody ridiculous

yet the barrister mentioned nothing in court? what a joke.. :eek:

my missus wasn't allowed to speak at that point to say it had been messed about with, they tried to bring it up at end but judge said "she had heard enough"

Sure. I'm currently unemployed, so drop me a tenner and I'll do anything.

The only help I can offer, is to say speak to a solicitor. However, I'm sure you know that already.

Absolutely disgusting.

I would find it incredibly difficult to not seek retribution in a situation like this.

not sure, they cropped a picture rather than altered it

I was mistaken re the diagram, it was here version of what happened but this does differ to the one sent to us with the case papers, this was her 3rd different version of events
 
Pretty sure you can appeal a crown court, however you'd have to watch out of them changing their story again.
Also £15 legal cover doesn't really matter, you don't generally choose / speak to who's represents you for traffic accidents insurers deal with all that stuff.

If you do go to magistrates court you get to redo it all again.

Cant belive it, i know how you feeling mate.... Few years ago now, i was 17 and hadnt been driving long.

I was reversing up a narrow street to get out of the street.... and bang and old lady pulled out. Damaging my right rear bumper, and her right front wing.

She was adamant that she was in the right and i was in the wrong (apparently i reversed in to her when she was still in a parked position?????) But the damage on both cars makes it obvious that she pulled out from her parked space!! And anyway whats the coincidance of her being in the car in a parked space while i reverse into her!!

In the end it came to a 50/50. It affected my insurance for 4 years and i got raped over them 4 years with high insurance prices.

What did i learn from this episode? Even though i phoned the police (police agreed with the way the cars were resting after the bump that she was in the wrong) get a statement from the police man!!! And take as many photos as possible of the crash scene. Unfortunatley i didnt have a camera phone back then hahaha :)
