council parking ticket

Just need to know if this will get dismissed.

Basically I was parked up on a road with a lot of other cars (10-15) on double yellows. I was on my phone which was the reason why I pulled over. I was sending a message and a parking attendent knocked on my window and told me to move. I said Ok 2 secs let me just send this then I will move. At this point all the cars that were parked up formed a que on the road blocking me in. The parking guy then started to write his ticket as I was pulling away. I checked in my mirrors and it looked like he was filming me or taking a photo, so I pulled a U-turn and pulled over on the side of the road again to confront him. As I approached him he took a picture of my car back on the double yellows. He then said how do I want the ticket either now or post? I said now and I will appeal which I have.

Now am I correct in believing that he has to take a picture with the car on the yellows with the ticket? and due to me using my mobile he cant issue me a ticket?
I have appealed like I said stating I was using my phone and believed it was ok to stop on the double yellows cause all the other cars were on them as well. what will happen with my fine/ticket?

Admission of guilt right there - well done, now pay your fine and don't do it again.
 
your utterly wrong on all counts.

There is no provision to say you can park on double yellows to make a phone call. And thats putting it politely.

Your going to have to pay it.
 
You won't get out of it.

My car broke down last year, & I had to push the car to the side of the road, on yellow lines.
It took me about 35 mins to arrange someone to come out to me. In that time I got a ticket for parking on yellow lines.

Appealed against it & I was told by the council that as a motorist I am responsible for my vehicle bieng
fit & roadworthy to complete any journey I undertake. :rolleyes:

When I asked what else was I supposed to do, I was told I should have parked in the designated parking areas....
aprox 1/4 mile further down the road !!
 
He gave you a chance but you ignored it and finished sending your message when you could have driven away. You have no chance of appealing the ticket.

You are lucky you weren't in Edinburgh you would have recevied two parking tickets one when you were on your phone and the other when you returned to confront the parking attendent.
 
If I recall correctly, they have to either hand you it or put it on your windscreen*. You shouldn't have parked on double yellows anyway to send a text.


*This was the law when I worked as a Parking Attendant for a local council, but I'm not sure if this is true for other Councils.

Hold on a minute - I was under the impression that being sat in the car with the engine running isn't classed as being parked, but 'waiting' for which you can't be ticketed on double yellows? Only where there is a 'no waiting' sign should you be ticketed in this instance?

If that were the case and he were to argue it, he'd be admitting to using his mobile whilst driving. AFAIK the engine must be switched off if you take a call at the side of the road for it not to be an offense.
 
My engine was running to state that I wasnt parked but apparently he said that I was parked and that I should have continued to drive using my phone. I said that its against the law to do that and he replied saying that I shouldnt off pulled over to use it. So in his words its ok to use your mobile phone whilst driving if the road has double yellows. I understand that parking on then is wrong but I didnt know that I was allowed to use my phone as well. Just like someone said about them braking down.

I called up the parking office and they have recieved my email and they said I will get a letter within the next 14 days. Hopefully the fine will be removed but next time it happens I will just leave my car 3 foot away from the curb then it wont be classed as parked just stopped in traffic and if a police officer drives past and asks what Im doing I will tell him my story and see what he says.

Your 100% at fault. The wardon knew what he was doing.

As i understand it the rules are if your in your car on double yellows they give you one warning to move on and if you dont they can ticket you. You didnt move so he had you. Im suprised he didnt get you for parking on the otherside aswell. Worcester car parking wardons are not to be messed with (speaking from experience :P)

You were writing a text not hardly life of death!!! Could it not of waited 10 minutes till you found a better spot?
