Hardly, it's unsolicited goods, they are intentially sending you goods (photons/tv programs) without your request, with a view to you using them, and then demanding payment and threatening legal action. If it wasn't a government organisation (for all intents and purposes) it would be illegal under the "Consumer Protection (Distance Selling) Regulations 2000".

It is (although easier if it isn't plugged in to an ariel). The Licencing authority have to prove you are watching live broadcasts. Having the TV tuned in but off would not stand up in court. The only legally binding way of getting caught is if the TV licencing people are in your house and see the TV on. Anything else and you don't have to pay squat, problem is a lot of people 1. Don't realise this and 2. Are afraid of the big fine they are threatened with (even though there would be no way a court would uphold it), so pay up.
Either way, if you have your TV/video recorder plugged in to an external arial then most of the time you probably are watching TV and as such deserve all you get...

it's not at all, it only becomes a product once you decide to buy equipment and tune it in to display images.
They do not ask for payment on the radio waves.

At the time I didnt even have a TV, only the videorecorder. Anyway my parents paid the fine and it was over 20 years ago, before satellite and mobile phones, PC tuners and such so it may be different now, although the Citizens Advice Bureau agree with me.![]()

The radio waves are free, there is no charge for them and no way to stop anyone receiving them. there is no way your argument stands up in anyway.
it is invisible, is not solid and is licensed by the government. it is NOT a good.
