fully comp insurance wont pay out?

my mate at work crashed his scooby into a network rail battery box which had been dumped in the middle of the road. apparently he was only doing around 20mph (surely he would have seen it?)

anyway after hitting and going over it. hes twisted the chassis, the radiator oil sump, engine mountings,bonnet all wrecked and who knows what else.

his initial phonecall was to network rail to try and get them to pay for it but they were having none of it. so he called his insurance company.

now according to my mate he has fully comp insurance with elephant but they wont pay out. apparently its in the small print but surely if its fully comp you get a pay out and increase in premium the following year?

ever heard of any exclusions like this? will i find if i hit a tree my insurance wont pay out?

something doesnt add up to me.

This makes absolutely no sense at all - if he has had a crash and damaged his car, they should pay out unless he was under the influence of alcohol which I'm presuming he wasn't.

There has to be more to it than this, what reason have they given for refusing to pay out?
 
all hes told me is it was in the small print. ever read any exclusion like this?

like u say it makes no sense at all unless he doesnt have fully comp and he is billy bull******** me. he was boasting about how his insurance was only about 500 quid and as he is 24. i find it hard to believe.

i will do some more digging tomorrow when i see him at work

something about it not being a rta i believe thinking about it. ive advised him to get onto the insurance ombudsman. dunno if he actually will. something definitely isnt right.
 
i can only remember some of the exclusions off hand but things like street racing,acts of god and war aren't covered, so i dont think he given you the full story:rolleyes:
 
tbh he drives like a absolute nutter anyway. sometimes i have no choice but to get a lift home with him and he showboats around trying to get the back end out of his old mr2 etc. i dont like being a passenger in his cars one bit. ive always said he would come a cropper ans it looks like he has, big time!
 
i expect so. if he was only doing 20 then surely he would have seen the thing and stopped. the scooby doesnt exactly have poor brakes does it.

i can sympathise that there should not have been anything in the road but still.

i might stop at his house tomorrow to get some epic fail pics!

but unless he is lying to me then there is absolutely no reason why the insurance wouldnt pay out surely?

it depends on the reason why they wont pay but if they state not to do something and then he does, then he can only blame himself ?
 
I'm not being funny, but if I hit an obstacle in the road enough to do THAT much damage I would be calling the police to get themselves down there and work it out.

Has he just driven off then called Network Rail "Yeah so like I hit something of yours and busted my car, cash kthx?"

I would tell him to sod off also if I was Network Rail.
