Wages Overpayment - Advice please?

Just phoned the debt collection agency that sent me a letter this morning and explained to them, they're going to get hold of McColl's and explain to them they owe me £80.73, awesome :D
 
One last thing though, that 4.17 days pay will be subject to tax and NI so it may not leave much after cancelling out the £73.11.

Should have brought that up earlier, sorry.

Well, it's been nearly 2 weeks and I've not had any sort of contact from them, time to send a letter with my counter-claim in full. How long should I give them before taking any more action? 4 weeks is plenty of time, yes?
 
Recieved a letter today confirming that the calculation that Greebo kindly worked out for me is indeed correct, and they will be paying me £80.73 in their payroll for this month.

Thank you so much for your help, 6 months of hell is finally over, and in my favour (rightly so!) - much more helpful than the CAB, who I'm quite disappointed with.

Seems odd they are going through the effort to chase £73.

I know a Chemist who left his job and the company carried on paying for months and he was overpayed £11k overall. They never asked for it back.
 
My work over paid me my salary at the time was £15,400 they paid me £15,900 over the year.
Had a little meeting with HR and they said I did not have to pay it back as it was there balls up. :)

And they got their comeuppance - chances are if they'd kept quiet about it all they wouldn't be paying out now - even if it is only £80.

Nice work Greebo! I now know who to turn to if my salary gets messed up. :p :D

Did they pay you for the holiday you accrued in the time you worked there? (assuming you didn't take any)

Yep, my final pay packet consisted of:

-£269.22 (full week's wages)
+£169 or so (holiday accrued)

Plus a few quid for NI etc, which came to the £73.11. Didn't take any holiday in the time I was there. Just glad to have a result from this! :D

Don't think I should really take it any further, I'm getting what is correctly owed to me and whilst it was indeed a very stressful experience, I'm not sure seeking any further compensation from them would really be worthwhile. I'm not a money-grabber, I just wanted what was rightly mine :)
 
Id do it for the fact they tried to screw you over. Intrest + compensation = win. Your bosses seem like total asshats to screw over and pursue debt collectors for something that was totally the opposite!

Just as something that might be useful, check to make sure they paid your accrued holiday correctly. With regards to payments, your holiday entitlement should be calculated including public holidays (so your normal entitlement + 8 days), and then public holidays taken subtracted from that.

So, for example, you have 4 weeks annual leave, and leave after 15% of a year and you took one bank holiday:

20 days + 8 days = 28 days * 15% = 4.2 days - 1 public holiday = 3.2 days holiday pay

EDIT: If you were entitled to 4 weeks holiday, then you should have accrued 3.3 days pay in that time, and there were no public holidays in that period.

My contract says:

Your entitlement is based on 28 days paid annual holiday which includes public/bank/customary holidays. Due to the nature of the business the company reserves the right to request you work on 3 days of any public/bank/customary holidays.

Should you leave, your entitlement will be calculated pro-rata for completed calendar months of service in that holiday year. Any accrued but untaken balance in days pay will be given to you in your final salary, unless you leave without giving any or sufficient notice

Well, I left on the 11th November and terminated my contract with immediate effect. I gave no notice, but I was on a 9-month probationary period, doesn't that mean I can leave without notice though?

Yeah they were asshats alright. I was lucky to get a day off in the week and quite regularly worked 60 hours or more. On my salary, that's £4.48 an hour - for an assistant manager's job. Not great, really. With regards to compensation, I'd have no idea how to go about it anyway. I'd love to get one over on them big style though!

If your a temp you can leave and give 1 days notice, only trouble is most contacts cover this by having you work a week/month or you loose your holiday entitlement
