Traveling to US with conviction

My mate is planning to visit LA in 2 weeks and he has a conviction for ABH from back in 2006

i always thought if you had any criminal conviction you couldn't go to the US

and when i asked him about it he said all he is going to do is not declare it if they ask

it cant be that simple can it?
makes a mockery of the system imo
 
Guy who works with me has a D&D conviction and had loads of grief going there, it can't be that easy....
 
They are not happy wen they find out you have a conviction. A mate of mine got of the airport at florida and they literally bollocked him for lying.

Yes they can find out if u lied!
 
Yes, indeed they can check. One of the delights of international travel - your identity can follow you - and this is especially true of the US.

Call the Embassy. Most likely won't quality for VWP and will need a Visa. Not sure if they can sort one with two weeks' notice but better than getting denied entry (which is a possibility).

anyway it appears he is leaving today and he has uploaded pictures to his facebook via mobile with him on the plane etc

so im guessing he got away with it rather easily

not really, he's got to get through US authorities, UK airport wouldn'lt have stopped him

I'm guessing he'll be turned back at the US Port of Entry. The US is VERY stringent on scanning its visitors... and normally waits for them to arrive before shipping them back on the next flight, normally at the travellers expense.
 
Chances are he will be spending a few hours in an inteview room discussing his crimes, before being put on the next plane home, this may not be the same day, so may end up in a holding cell/room till a spot becomes free...

I'm afraid it's not that simple. He will not be stopped at the UK airport but at US customs control. Which means that there is a possibility they will take him for an interview where they will ask him to declare whether he has a conviction or not. At that point, he can either come clean and be denied entry and returned back with (presumably) a ban for a few years OR he can try to lie, he will fail (because they do check and they usually know before they even ask you) and get a permanent ban and returned on the next flight home!

He might be very lucky and get through, you never know. However, knowing that the consequences are likely to be a lifetime-ban (even if they give you a 5 year or something similar, it is practically permanent because they won't allow you to get a visa again, in most cases) it is a big risk.

Having said that, even if he had tried to proper route by going to the embassy, declaring it and trying to get a visa (he would need a visa in his case) it is more than likely that he would be rejected. However he wouldn't have a ban which means he would be able to travel in the future. But if he doesn't care about going to the USA in general and it's just a one-off trip, well good luck to him - he will need it!

I've heard if you tick the form to say you have ever been convicted or whatever it can cause you grief, no matter what the reason for being arrested, D&D isn't moral tertptitute so would not need to be mentioned, i think for high profile crimes such as terrorism or drugs there is a database.
