I'm screwed right? [scammed on eBay]

Quick update - got an email from eBay today. The case that I opened on eBay for not receiving the item has been close. As a "one time courtesy" they have decided to refund me the cash via PayPal. Honestly can't believe it, I had written the money off to be honest. eBay have gone up in my estimations a lot now!

Bought something on eBay recently. £120 + £15 shipping.

The guy had a good rating (300+) and asked if I would mind paying via cheque as opposed to PayPal. I weighed everything up - and whilst obviously a little worried I decided to go for it. I looked at his history and he hadn't been selling huge amounts of expensive goods and every thing seemed to be ok.

I sent the cheque and it was cashed. Obviously I never received the goods!

I have opened up a case with eBay but cause I paid by cheque I won't be getting any money back from him. I did a bit of digging and managed to find this page:

Pretty annoyed with myself and should have gone with my gut feeling and backed out of the purchase. Nothing I can do to change that now. I am trying to work out what options I have now?

I have phoned the bank and there is nothing they can do to reverse the cheque. I am thinking my only option is small claims court? The odds on him turning up however I would imagine is minimal - what happens if he doesn't turn up can the court force him to hand over the cash?

Really annoyed with myself on this one - been using eBay for years without any issue!

he doesn't need to turn up, you can still win. However even if you win it is still hard/imposable to get the money of them. Unless they care.
 
How would I be able to find out what his bank account is? I phone my bank and the didn't seem to think I would be able to get any details - the guy on the phone didn't sound too bright though.
 
Go to the bank in person, people over the phone are usually too dense at banks and do all they can to get you off the phone.
 
You would be surprised the role that the police can play in these situations. One user of this forum decided it would be a good idea to charge me £20 for something that never materialised. I later found out that he had done the same to a number of other members.

That user was arrested 2 weeks ago on suspicion of fraud. It really is worth a go!
 
bank wont do anything, they can't you aren't the police and data protection.
As above report it to the police it is a crime and you should have enough info for address.
 
Unlucky mate, sucks to hear you have been done. I assume he has gone incommunicado and all that jazz?

What was the item for out of interest?

It's a sad time when someone like yourself who has been using the bay for years successfully, with a good knowledge of how it all works and what the do's/don'ts are manages to get done over.

Completely removes any tiny bit of faith in the system that might have existed. Good luck with recouping your losses.

Do you have his name and address handy? I could get the lads together and we could go round with the intention of skull bashing with our keyboards if it is local!
 
Phoned the police in his area. Basically I need to send him a letter (by recorded delivery), giving him either 7 days to refund me or supply me with the item else I will be reporting him to the police for 'obtaining by deception'.

Also for your info I sent the OP's multi coloured vibrating butt plugs by first class recorded delivery on the 19th so he needs to take it up with Royal Mail :)
