Anyone know about re-possession?

I have received a 'Claim form for possession of property' from Nuneaton County Court.

This is no surprise as I've known this was going to happen for quite some time and have even planned for this eventuality. My estranged wife is still living there though with my 20yr old step son and my 6 yr old daughter.

My question is, how long from this point do they realistically have until they need to move out?

I hope you have thought this over.
If you have a mortgage on the house and the bank sells it you will have to pay the short fall if it is in your name.
There is no escape from this and even the 6 year staute bar rule does no apply here on this type debt.
I suggest you ask for advice on money saving expert forums.
 
I think you need to go and see a solicitor tbh. Getting free advice from the internet and the CAB is all very well, but you get what you pay for in the end.
 
They'll probably give 14 days or something so they KNOW the letter has got to you.

But get them out way before that. Having big and burly men ordering people out of their houses is downright humiliating for them.

Though I would go with what above says get out and see a solicitor as the bank sells houses cheap my flat mate got his at 60% of market value from a bank thats a big deficit you would have to make up. :eek:
 
I would recommend getting as much out of the house as you can as soon as possible. I was living in a rented house which was repossesed whilst i was at work one day (had no prior warning), they just turned up, forced entry and changed all the locks. I rang the number on the piece of paper they attached to the inside of the window and they told me there was nothing i could do about getting my stuff back until they turned up and i could prove that the stuff was mine.

Ended up going round the back of the house and whilst looking through the back door it suddenly gave way, and as it wasnt me that forced entry (honest) i proceeded to remove my belongings and made sure most of the landlords also were taken to ensure they weren't stolen....... ;)
 
Have the court heard the case? If so they should have given you the chance to attend & plead your case.
If they have sided in the banks favour (usually do) then you will get a formal letter within a couple of weeks stating you have two weeks to vacate the property.
There will be a time & date on the letter, stating when they will attend the eviction & you will need to be out by then. You rarely get any leway time with them.

No the court haven't heard the case yet - this is the first time the court have been involved.

In response to some other questions - yes I have sought advice and yes I have thought it through and no I wont be liable for shortfall from sale and I'm officially bankrupt and this has been taken into consideration.

I have kept my ex abreast of what's going on but I would like to be able to give her a realistic time-line as to how long she has to find somewhere.
