Hay all.

Ok got a new contact from phones4u .

I got my new phone on the 9th and today when i called up vodafone to activate my sim they said i needed to call phones4u to get them to send the details of my contract over to vodafone as they have not got the payment plan or anything.

So i call up phones4u and they said that vodafone now (after i called them) won't let me have a second line with them

I pretty sure they do all them checks before they send you out phone and contract.

I am now transferring my 1st contract into my gf name.

But where do i stand on this can they just turn around after giving me the contract and phone and say no you changed our minds lol

I getting called back from manager at phones4u i am not a happy chappy.

Thanks for any advice you can give.

Surely that's Phones4U's tough luck, they should have sorted your contract out before you got the phone etc.

Is there anything stopping you from keeping the phone now they have given it to you because they didn't set the contract up?

Well the women over phone was saying they would send a bag for me to post the phone back.

I don't know my rights where a stand on this sort of stuff :(

I mean i am pretty sure i can't keep the phone they would want money for it or some thing or take me to court if i don't send it back lol

I can't put my old contract into my gf name (creditcheck) lol

Going to keep looking see what i can do about this.

I think i only have 2 options

1 send phone back and get the same phone on another network.

2 send the back phone back and wait and see about the iphone 4

What you think ?

Thanks.

Tell them you've signed a contract with them and if they breach the contract by not being able to supply it then they will be liable for any loss you incur (ie the difference between their contract price and the contract price of an alternative supplier).

Indeed, say this and don't agree to anything yet.

They've obviously made a **** up and will now try and blag the phone off you when in fact, you might not have to give it back/be able to get a better deal etc.

Just hold on to it for the time being, don't sell it or do anything daft.

I did call up that consumer direct line and the advice the guy gave me was that u would have to give the phone back as i don't own it phones4u still have the right to ask for it back.

But is it true the contract does not start until the phone/sim is activated and in my case the contract was not started as i could not activate my sim card i think.

I am waiting for a manager call back from phones4U see what he/she says.

I will try and fight all the way see what happens. :)

Thanks all.

This is the reality of how contracts are done through 3rd parties:

3rd party needs sales as sales = money from the big 5
3rd party gives you phone, says checks will be done but you'll probably be fine to win the sale
3rd party system is usually broken (hi phones4u) so they cache it, send it later.
Voda does credit check
uh oh - system rejects it - contract not going to happen.

The contract is only good when both parties agreed to it. As voda have not agreed to their part because you failed the credit check, the contract is not complete. Remember phones4u are acting on behalf of voda, but they don't do the checking.

If you keep the phone you will be liable for the cost of it I suspect. If it goes further it could be sent to collections.

Oh well i can send phone back and get the same phone on another network no problems as it only vodafone don't like me having 2 phones for some reason.

Or wait for new phones to come out or maybe look at the htc desire does that have android OS ? if so what version.

Thanks.

The Desire has 2.1 currently and HTC have said it will receive 2.2 but the date of when this will happen is not confirmed.

If you get rejected it might be worth checking why - experian will give you a free credit check for 30 days (make sure you don't subscribe for more than the free month) if you want to see a detailed report. Voda's policy is here:

try to avoid WinMo, it's a bit Stygian in this day and age.
my recommendations:
Desire ::OR:: Nexus One

So i think i will go for the htc desire its newer then the Nexus One ?

I like the android apps so windows mobile i don't what the apps are like on that.

Thanks

Desire, forget the HD2.

Nexus One doesn't have Sense UI and I think you'll be better off with a Desire to be honest :)

The htc Desire seems like a great phone.

the wife has one from work, I've not really had a chance to play with it yet.

But I am impressed.

Ok good news at last :D

I was look on vodafone site just see what Samsung Galaxy S deals where and one of them sales chat boxes pops up asking if i need help.

So i told them what happend with phone4u and they said place the order on there site and it should be ok.

So she help setup contract and gave me a free gift Topup and go USB Modem Stick with 3 gig on it.

And just got email from vodafone saying.

Nothing wrong with WinMo 6+... but its a bit "techy" if you like to play and tweak, etc. then fine - if you want something that just works out the box, has a slick standard interface and integrated apps then android would work better for you.
