I'll keep it brief

You're driving along a main road, between 20 and 30mph, your indicator is still flashing from a previous manoeuvre and you're unaware. It's signalling that you intend to turn into a side road.

Someone then pulls out of a side road right in front of you because they "saw your indicators and thought you were turning" even though you showed no signs of stopping. You then hit this person.


Would you agree that it is blatantly the fault of the person who pulled out?

I certainly would!



And no it wasn't me before anyone asks :p
 
Yea person who pulled out.

I now wait to see some sign of a turn being made even when they are indicating.
 
Their fault as you still have priority regardless.

However, people who don't realise they're indicating should be shot.
 
As a relatively new driver I remember clearly being told and told and told (and probably told some more) to wait until they start to turn in, for this very reason.
 
I believe this was an OCUK case study in another thread, bottom line it was mutual liability.

You shouldn't assume anyone is going to do anything even if they are indicating, but i believe that someone else found in the highway code or something about making misleading signals etc.

I fell for that quite a few years ago and pulled out in front of someone i thought to be turning. Insurers decided liability was split 70/30 against me.

This. Person who pulled out is legally at fault, but the person who can't use their indicators is the bigger idiot.
