Just received an iphone 3GS I never asked for !

I have just signed for a package and found that it contained an iphone 3GS from O2 on a postpay sim. It was addressed to me but I have never had an O2 contract of PAYG phone.

I have checked all my credit cards to see if it is a fraud attempt that was sent to the registered address - nope all my cards are fine...

One card company even said that they have had 100s of calls from people who had been charged money by O2 but I was the only one who had not been charged but had received goods :eek:

Now - my understanding is that these constitute unsolicited goods and are covered by the Unsolicited Goods and Services Act 1971 and as such I may retain them as an unconditional gift :)

Can anybody confirm that this is the case ?
 
if you've not paid for it, it's technically not yours.
although, if they've posted it you it's their mistake so not your fault, i'd leave it boxed ect. for a few days and see if you hear anything, if not it's a free phone tbh.
 
Ring 02 and let them know, apart from it being the right thing to do, just because you haven't been charged yet doesn't mean you won't in the future.

My first thought was to send O2 a registered letter giving them a certain time to collect it but then I thought why should I pay to send a letter/call them ?

The Unsolicited Goods and Services Act 1971 is designed to cover the situation where a company sends goods and then tries to charge you for them. The fact that O2 have sent the goods to me when I never asked for them means that - by my understanding - the title passes to me.

But if people have other interpretations of the act then I would be very grateful for any opinions.
 
I believe it would only be considered an 'unsolicited good', were it intentionally sent to you without you having paid for it. I know that it was addressed to you, but there's a high probability that it arrived in your possession via a mistake at their end.
 
It's an iPhone,

The best thing to do with those is to SEND THEM BACK!
 
I would contact o2 just to see whats going on, don't suppose you entered any competitions over the past few months? May have won and its come direct from o2 :)
 
Contact O2 because it's the right thing to do? Kepp it lol it's one phone from a massive faceless corporation they aren't going to care or notice it in anyway.
 
afik you have to make them aware you have their goods and they have to arrange collection at their expense. If they don't then after a certain amount of time you can legally keep the goods.

If there is no invoice of actual charges or anything. There is no way the OP cannot know that this was indeed a free gift by o2.

It is upto o2 to realise their mistake (again the OP doesn't know its a mistake). He signed for the item meaning o2 know already.
