afik you have to make them aware you have their goods and they have to arrange collection at their expense. If they don't then after a certain amount of time you can legally keep the goods.


I was too under this impression.
 
Inform O2 they have 28 days to collect the phone
If not you will dispose of it.


That is the law

He has done so by signing for the package. Why should the OP go to any more effort?

The q&a site i've seen says,

6 months to collect item before it becomes yours and that is reduced to 30 days if you contact sender.
 
Keep it for a bit, see if anything happens. If not, jailbreak it and use it (so your details aren't sent through to O2 raising concerns).

O2 will do everything in their power to screw their customers out of extra money. Sucks to be them this time.

If there is no invoice of actual charges or anything. There is no way the OP cannot know that this was indeed a free gift by o2.

It is upto o2 to realise their mistake (again the OP doesn't know its a mistake). He signed for the item meaning o2 know already.

Bad businesses which accidentally give away items lose money. I don't see what moral code you are breaking here.

The same way a business which causes billions of dollars worth of damage will be sued till its bankrupt. No one should go soft on them because the shareholders are suffering.
 
As per the terms of the Unsolicited Goods and Services Act (1971), you can either:

a) ignore, ie pretend you haven't received them, and the phone is yours after 6 months. However if O2 wants it back during this time, you can't refuse to let them collect, or if they are willing to pay the return postage, you should send it back. You cannot use it during this time, and must keep it in good condition.

b) You can write to O2, stating that the goods were unsolicited, and give them 30 days to either collect them, or arrange for them to be posted back at their own expense. After this period of time, the phone is yours.
 
Keep it and to be safe wait 6 months but I bet you wouldn't wait that long anyway!

Also be aware that once they are sure they have lost it, they will blacklist it and it will never work in the uk again (This happened to me when 3 delivered two phones to me by mistake and they blocked one).

Of course, nothing then stopping you selling it on Ebay to a foreign country on the basis that it doesn't work in the uk. I got £130 for my phone from a guy in Amsterdam.
 
Phoned O2 and they have passed it onto their 'fraud' department. Who will contact me within 48 hours. So we'll see.

Apparently the account had been set up with a pass phrase and everything so unless I knew that, I couldn't even get into the account to see how it was being paid or anything.
 
So the person managed to set up a contract without your knowledge. You certain that a direct debit on your account wasn't created?
