Ebay screwed :( Ruined my month!

Don't you think the Cops have more important things to be dealing with ?

Seriously. Think about what you have stated......

1.) He has 100% feedback with thousands of happy customers.
2.) He said he had the tickets - yet his card was declined when he bought them.
3.) You have paid over a grand for something that was promised.
4.) He now doesn't have the money - or for some reason doesn't want to pay you back in full.

Firstly - if you have his number - call him - and see WTF he is at.
Secondly - if you don;t have he number, contact his past customers - and get it if you can.
Lastly - if you can't get his number - contact his past customers - and get his address. At most it will cost £30 to get to his house and get your grand back.

This isn't about some £20 transaction. This is over £1000 of your hard earned money, and the more people on Ebay that lie down and let themselves get rear-ended - the more dodgy dealers will sell non-existant things on there to make an easy buck to the increasing number of suckers that fall for it.

We have over 55 emails now so plenty of contact has been made. Why would i go through all that trouble when i can just get my bank to deal with it?
 
You mean, like catching crooks? Just because it's online doesn't mean it's not a crime.

Most police forces don't want anything to do with this sort of thing. They are too busy worrying about their reduced budget and the increase in Rape/Violent crimes and burlaries that most people are giving off about them not responding too. Do you honestly think they are remotely concerned about one single ebay grievance - when they have 50 or so officers chasing after drunks and wife beaters ?

How would you feel if you phoned up to report an assault (as hundreds do on this forum) - only to be told they were too busy (recording yet another of the thousands of daily British ebay scams)

Well - it's your money - so ultimately it's your mistake and your problem. I'm just amazed you are so sure your bank should sort out your mistakes. Do you think it's their duty or something ?
 
Also, go to the police. Its theft.

It's not theft,

a) Its a civil dispute, courts not Police
b) The seller is not trying to permanently deprive the OP of his cash (the definition of theft)

OP, i had similar with a Laptop and paypal were useless, i got my money back - did you pay via a bank transfer or via debit card long number ? If later you have very similar cover to credit card but its not as well known/advertised.

I'm on the planet where theft by deception of a thousand pounds is considered a serious crime and the police have the duty to deal with it. At the very least it should be reported for crime statistics so police forces can operate accordingly. I also come from the planet where I've worked in the business intelligence unit at my local force headquarters. Theft of a grand, whether it's a knifepoint in the street, or electronically via deception, is theft of a grand.
 
They wont deal with anything thats over 45 days old

I believe listings where the goods aren't in hand are against ebay rules. The OP should not have been willing to wait more than a week for delivery of such goods without filing a dispute. Those are the ebay rules.

If you are willing to buy a promise to give you tickets, then there is little ebay can do.

If the seller is a business seller, then you have a lot more rights outside of ebay.
 
I can't speak for other jurisdictions, but that article highlights why wikipedia is pretty useless. There is no such thing as a small claims court in the UK despite England & Wales being listed in the article - I'll add something to the discussion page now.

I don't think its pedantic. Going down the small-claims track does not leave you in a different court or even courtroom; 90% of the same rules apply as if you were dealing with a multi-track application and you are not left with a non-legally trained judge. An action brought under the small-claims track can become fast-track, which would not be possible with a separate small claims court.

Do the email addresses quoted here not perhaps suggest that this is referring to people who have received spoof emails from ebay/paypal, rather than people who have been scammed out of hundreds of pounds?
 
Maybe they do.......but if you read above that - it's heading is (Reporting fraud - Bank & Card Fraud, Scams, eMails and Web Sites) - which is what everyone in here is stating this case is.

The Met website quite clearly states that all ebay Fraud/scams/phishing stuff should be directed to......"Paypal or Ebay should be sent to [email protected] and [email protected] respectively." - at no point do they state that it's anything to do with just spoof emails or phishing. They simply do not want anything to do with dodgy ebay transactions or failed deals.

So be my guest and go to your local Cop shop to see what they quote you ;) And ask them are they busy enough to deal with it..... I'm sure you will be surprised..... as many of my friends and business partners have recently found out.

My thoughts:

1) The Police won't do anything unless there are several reports against the same guy. Even still it won't resolve your problem.

2) Don't think there is any point in trying small claims court stuff. The guy has already said he is willing to pay you back so why go through the courts for the same result.

3) I am surprised your bank say they can claim the money back. Usually you can't with a debit card transaction.

4) I'm not sure if they do charge cards immediately as a freind told me thats how sometimes more tickets become available randomly, after cards get declined. Not sure though.

5) I feel your pain. Do you not have the money/credit card to get more tickets off ebay? It sounds like you will get the original payment back eventually. I have been looking out for tickets for friends so I know they are quite pricey on ebay this year, demand is a bit mental. If I hear of any at a decent price I'll let you know.
