Ok hi GD.

Basically yesterday I was invloved in an accident which I dont believe to be my fault, I dont think the woman who was in the other car will take liability( Not got any confirmation insurance will ring back tomorow) and I want to know where I stand which to be honest isnt looking good. I'll try and explain what happened as clearly as I can.

I had pulled into a lane for a slip road and was doing about 60mph(standard 70 limit) and all off a sudden I see a another car 2 lanes across with white smoke pouring from the back of it, it veered across 2 lanes and the chevrons indicating the filter lane and was now infront of me. The white smoke coming from the back of her vehicle is now blocking my whole car i put my hazards on and start to break as im not sure what shes doing or where shes going, bearing in mind i cant see a thing, no lights, no car no nothing just white smoke. she must have slammed here breaks on pretty quick as I went straight into the back of her, shes obviously just stopped on the slip road. Bearing in mind about 50 yards down the roads a bustop or she couldve stopped in the chevrons or not in the middle of the road basically.

Now ive asked a couple of people and basically they reckon ill get bummed by my insurance as I hit her, but shes veered across 2 lanes including chevrons and stopped very quickly infront of me with white smoke pouring out of her car, im not sure really what I was supposed to do.

I'll wack the road on google map if anyone reckons it'll help. Just pretty peed off as ive only been driving for 6 months and i already payed a bundle for my insurance and i'll reckon it'll skyrocket.

First of all VV Motors VV is down there

Next I would say if it's a defect on her vehicle and SHE has lost control causing the accident then she would be viable.. but i'm really not sure :)

Were the Police involved? if not...

Aye sorry wrong forum.

Yes the police came, he basically said he wouldnt prosicute anyone and its up to our insurers. She said to the policeman that her car went from 60 to 80 mph by itself, thats why she came over the lanes and stopped.

lol, if she says that her car went from 60mph to 80mph by itself to the insurers, I think you have a good chance of winning !

remember that muppet in the BMW who was doing 100mph down the motorway saying that he couldnt slow the car down ?

The Rozzers annoy me immensely...

Her vehicle may have had a possible defect and they aren't going to investigate.. god forbid they have to fill in any paperwork lol.

Edit: Also did you get their Collar Number... if she suddenly decides to change her mind.. you may need to refer back to the 5-0..

In one swoop there she's admitted a major defect, speeding, veering across two lanes and stopping on a slip road.

As long as you get his testimony i think you'll be ok.

*total layman's opinion though.
 
Did you get witnesses? clearly her fault but without witnesses its going to be a hard one to win outright.

Motoring laws, driving tests and so on rarely make sense to me.

I failed my first driving test for "lack of anticipation" or some other rubbish. I was stopped at some temp roads works, i was at the front and when the lights went green i saw there were no cars coming the other way and moved off.... halfway down stretch ( on the wrong side of the road as the other was dug up ) some guy reverses out of a drive on the side i am on and turns to face me!... i had no where to go as cars are behind me now and he just sits there beeping his horn!

There were high hedges and walls on all the drives to there was zero possibility of knowing if someone was going to come out of a drive. I was failed as i "should have anticipated that someone might have come out of a drive"... so the only thing i SHOULD have done it sat there untill the roadworks were removed? Bloody idiot examiner cost me a further 2 weeks and £40!

Surely you could just put it in neutral/clutch/turn the ****ing thing off, and let it coast a bit before pulling over as the speed drops before coasting to a halt on the hard shoulder with hazards?
 
No witnesses unfortunately, there was a car quite a way behind me hence why I didnt Emergency stop when all the smoke covered my car but he just went by us :(. I got the policmans collar Id n that though.

I think you'll find no matter how you drag this out, it'll get - rightly or wrongly - nowhere.

Whilst its unfair, I bet you end up being regarded as at fault. :(

Im not totally convinced on this one. Is the defence 'he should have slowed immediately as his visible distance was greatly reduced?'

I'm not so sure on that personally.
 
Well thats it, should I have stopped and possibly had another car go back into me, I dont know, could she of stopped of stopped somewhere else and less dangerous? lots of other places to stop.

Agree. Not your fault if situation is as you describe, but for the insurers, it will be a whole lot easier to say "you hit her, your fault", you were following too close or whatever. It will save the pen pushers a whole lot of work to drop you in it, but they wont give a damn.

But he wasnt following her too closely, from what it sounds like she came infront of him and put him into that position.

I would fight this mate, as long as how you said it to us is true, I think you will win this one. Were there any cameras or anything on the road that could reply the accident?
 
Nah mate nothing at all, no cameras no witnesses that stopped anyway. Yeah she did come straight across me (ooer) then all I seen was white smoke, hit my brakes and my hazards but obviously she mustve slammed her brakes on :(
