If I were him, and judging by the haphazard way these things seem to be sent out I may well be, I'd take the offer of the free legal help and then cite the fact that Torrenting sites are now using false IP addresses to hinder the anti-pirates efforts and that others openly use known active IP addresses - simply put this across then hopefully any judge/jury will see that in all possibility your friend is a victim of this

You aren't responsible for your PC being hacked. You're not responsible for your WIFI connection being cracked and someone else using it to d/l the material. If they make an allegation, they have to prove it in Court.

As far as I know, that is not illegal....yet!!!

Anyway as far a torrent s are concerned, can't you simply use PeerBlocker.

Don't worry about it. I'll explain it to you when I get back. You basically just need to subscribe to a newsgroup provider.

With encryption nosey people have no idea what you have downloaded, and almost all usenet providers don't keep logs so you can't be found out that way.

Peerblock is only as good as the list of IPs. You can't predict the next "bad" IP so the list will always be incomplete.

It doesn't matter, if he pays the internet and owns the equipment etc.. and the offense is recorded to his IP he would need to prove that it wasn't him. As far as I am aware.

Is it illegal to download Music-Video from sites such as piratebay?

As the video is a promotional tool is it regarded as free?

I would have thought the onus would be on you to show you had compromised security on your computer one way or another, not that the prosecutors would have to?

No mate. If an allegation is made, the prosecution have to prove that the user downloaded the suspect data. So, for example, not only would you need to prove that the data was downloaded on that PC, they would also have to prove that it was a specific individual. There are certain ways of doing that, which I am happy to explain if anyone is interested.

Forgive me, I don't take too much of a personal interest I rarely download anything, let alone copyrighted stuff nor have I read the Act.

Depends on the distribution rights - a site/company might have a license to distribute it as free but another site/company might not... theres "free" and free heh.

In a civil case it does not need to be proven beyond reasonable doubt and the person who owns the IP address would be held responsible though.

No, they wouldn't. They still have to prove the case, regardless of whether it's a criminal or a civil offence.

IANAL but would offering to pay only when they provide written proof of their loss not work? They can't offer proof as the loss can never be known, so how can they make claim against anyone? And if you offer payment, what can they take you to Court for? (Offering to pay?)
