Hi

I purchased a laptop almost two years ago (sold with one year warranty) and now I have a few issues with the laptop due to problems not caused by myself. They will not repair as they say it had a one year warranty only, however I think I remember seeing on watchdog or something that electrical items like laptops were protected by the EU for three years regardless of what the firm I'm dealing with says. Do I have a leg to stand on or not?

Thanks

Hi there,

Sale of Goods act as far as I am aware basically says a product should last a reasonable time, and for most electronic goods such as a laptop I think you could argue a case that it should last 3 years at least... would get harder after that. That's my view anyway.

Basically stores can give you whatever warranty they like but it does not change the law. Go equipped knowing your rights (Sale of Goods) and inform them of your rights. Retailers seem to rely on customers being ignorant of their rights or too lazy / can't be bothered with hassle to sort it.

EDIT: Without checking the legislation I think it is something like if a fault develops in the first 6 months then it is considered to be a manufacturing flaw, after that time period it is not automatically considered to be a flaw in all cases but more a question of whether it has lasted a reasonable time with the customer perhaps having to provide more evidence for this to support a replacement / refund / repair.

That said I would expect a laptop to last longer than 2 years without developing a fault and as such I think you have a case for repair free of charge by the retailer.

What problems would they be?

Under the Sale of Goods act the retailer is liable, not the manufacturer of the laptop.

Heat from the bottom has caused the graphics card to basically break, the screen is flickering.

The problem with this case is the retailer is the manufacturer and is known for their awful customer support.

i had exactly this. The laptop was out of warranty but they said it was covered for another year anyway so the call centre advisor got an engineer out to fix it.......

2 days later I get the laptop back with the fault fixed but it wasn't charging. 2 30min phone calls later and some very heated discussions later I managed to get the overseas call centre supervisor to agree to send out a second engineer to fix it. the fault was with the connector on the mainboard not being fixed up by the previous engineer. The supervisor wasn't having any of this and said I would have to pay if it was a ac adapter problem. I offered to pay for it 10times over if it was the case and got a third replacement mainboard.

when I was waiting for this I fired an arsey email to the pa of the top dogs of the company explaining the situation. Got a phone call about 2 hours after I had sent it from her apologising like crazy and then got £50 voucher through the door 2 days later.
