How long would you expect a "deposit placed" vehicle to be held?

Hi all,

Long story short, I had my bike fixed at a dealer and asked if they could sell it for me as I work away full time. They do this all the time for bikes so said no problem as they would simply price it X amount over the amount I wanted and keep whatever they get for it.

About 4 weeks ago I was told that someone had placed a deposit on it. Good stuff I thought, that means it should be shifted soon. Nope.

Every week I call up for an update and they say "The deposit is still in place but the guy is still sorting out finance...". What?! I can sort out finance almost instantly so WTF are they playing at? I think they're taking the **** a bit now and am looking to just take the bike back and just sell it privately. Where do I stand with this? Can I just go into the shop and take it back? They have even transferred it to a DIFFERENT place to where I dropped it off! The place I dropped it off at was down the road, the new place is over an hour away. Am I within my rights to demand they take it back to the original shop I left it at?

Am I being unreasonable thinking this should easily have been sorted within 4 weeks? I am due to go travelling in 3 weeks hence why I'm beginning to get a little stressed about it all :mad:
 
Tell them your coming to take it back on Saturday that should hurry them up then go up there and take it back if they haven't

Tell him he has got 1 more week to conclude the sale or you want it back.

What is happening to you happens all the time, they sell the car/bike then use the money to flip something else before paying you.

1 last thing to bear in mind, if that company goes skint while they have you're goods, you have done your money in cold blood.

Surely that's just the same as them nicking it so I can just report it to the police?!

That happens all the time, worst case scenario is they go skint and come reciever time you're bike is taken away (if its still there) as an asset.

I think its a terrible idea personally, with too much room for messing about.

They have a few dealerships and I have now spoken to the one that has sold it. They are saying the guy has already paid for it but they can't release the money until he picks it up at the weekend and they will then need to send the cheque in the post!

Not much I can do until the weekend anyway as I work in London during the week, so looks like I'll be taking a trip there on Saturday to make sure they give me the money. None of this sending in the post nonsense that gives them extra time to faff about if indeed they're sending one. I'll update at the weekend as I get told each week "Yeah it will be sorted next week!"

What a load of ******, they wont be refunding the buyer if he dosent turn up saturday, so whats the hold up.

I would be sending someone down there to collect a cheque tonight.

Well the dealer doesn't want to pay for the bike unless it's been delivered just in case the customer cancels and demands a refund.

That's the dealers problem, after 4 weeks of listening to rubbish i wouldnt be waiting till Saturday and then giving them another weeks grace accepting a cheque.

Well it's not that, what if the customer rings up on Friday and say's "I don't want that bike anymore mate' - for as long as I've known and worked with vehicles which have been offered for sale on SOR (Sale or Return) the seller has only ever been paid once the vehicle has been delivered - regardless of when the dealers been paid for it - simply because of the possibility of cancellations.

Especially with prestige cars it's not uncommon for stock to be offered as sale or return.
