What can I do about my GTX 295 Rights?

I ordered a custom PC from a website who I won't name. It came with everything. They built it for me. About 11 months later, the water cooling inside the computer exploded, thus destroying the graphics card. I sent the card in, and they replaced it. However, the card they replaced it with doesn't have an HDMI port I have to have. You may be asking why can't I just have a DVI to HDMI adapter? It is because my sound system for my PC uses HDMI for video and sound.

I rang them up, and they said they can't do anything about it because they replaced it with the same card which they clearly didn't!

What can I do? Have they stolen from me, or is what the guy said on the phone, saying they can't do anything about it true?

It is my first time on this forum so please excuse this post if it is in the wrong place.

You can get DVI to HDMI adapter that allow sound to pass through as my old 4870s came with them. Maybe give the store a call back and ask them to have a look for any spares they may have?
 
Don't you just need to connect a cable internally from your sound card to the graphics card, thus obtaining sound throughput?
 
I don't know for sure about your specific card, but dvi is fully capable of transfering sound, it doesn't use half the pins for data, its why on certain cards, AMD 2, 3 and 4 series cards had slightly non standard dvi to hdmi standards as it would push sound out over certain unused dvi pins, and the non standard adaptor would connect those pins to the right pins for sound on the HDMI cable, its possible, and maybe even likely your card can do the same thing.

Most of the time graphics cards outputs are designed to be multifunctional in that way, are you certain that neither of the dvi ports(might be limited to one of them) with the hopefully included dvi>hdmi doesn't still provide sound, it not I'd contact whoever the card manufacturer is, look on there forums or at the newer version card specs and see if its supposed to support it.

It might be a case of they didn't supply you with the required adaptor, because a "normal" adaptor wouldn't work on most AMD cards in the same situation because a standard adaptor will only have the wiring to change over video data and will ignore unused pins.

Maybe the guys that built your computer have a suitable adaptor. It depends did they send the entire boxed product or just the card and nothing else?
 
A DVI to HDMI converter and cable with audio pass through is what you need really. Give them a ring and explain. Stay calm though, don't use words like "stolen" because you will not get your point across!
 
sorry to hear about that, so the company replaced it with another GTX295 but it has no HDMI ? to be fair be thank full you got a GTX295, as they are not made anymore, althrough you can get refurbs which may be your best bet, but your still out of pocket.

or you could try to do it via sound card, but its a arse I know
