Was following a workmate into the car park this morning. As i pulled into the car park behind him, he went straight past my usual space, and I drove into it and stopped. I had my hands on the keys and was about to stop the car (handbrake on) when he then reversed into the space I was already in! He reversed about 3 meters before hitting my rear three quarter.

Now, am I right in thinking that as he reversed quite a distance into my stationary car, it should be regarded as his fault? His reverse lights were not actually on when I reversed into the space, and he was still moving forward.
 
You'd have to argue that you were stationary and parked up. How is he putting it? Witness's will help a lot in this case id imagine.

At least you will get rustless arches :)
 
That big crease in the rear 3/4 panel seam is going to be a big pain to replace, dont u think?

Car's value is only around 2k? Its going to be hard to argue a repair, or should i stick with it, and demand a repair?

Sales director was having a fag outside, and had a grandstand view of the whole thing. The other driver has not said anything in regards to fault.

We have not swapped details yet, and he works on the other side of the office, about 20 meters from me. I figure he is not exactly going to do a runner :p

Have you actually spoken to him about it as it sounds like your going to just whack it through insurance. Might be better to actually go talk to the bloke and see if you can come to the best arrangement for you both cost wise, that may be through insurance or it may be without them.

Either way you will have to declare that you have been involved in an accident even if you don't claim.

Technically as you were stationery it is the other parties fault, and you are entitled to have your car repaired to the state it was in before the accident. If you do go through insurance they can't write it off for being too expensive to repair. The claim is not with the insurance company it is between you and him and as such the other parties insurance has no right to your property. But if it is thought that it is impractical to repair you can accept a cash settlement if it would allow you to purchase a car to the same value as yours would be worth prior to the accident, but it's your decision.

Seems that way, but bodyshops can do wonders these days.

With the sales director as a witness, he's not getting out of liability, not that the witness was really needed in this instance I wouldn't have thought.

Is he a mate? Either way, you both need to speak with insurers.
 
He has informed me he would rather leave insurance out of it, which suggests he is admitting liability.

He has asked me to let him know of any quotes I get for repair.

We will see what happens next, stopped in at one place, and the chap is putting together an estimate, and I am seeing a Honda approved body specialist tommorrow.
 
After getting an estimate, £1355.36 (£1111.98) if they can re-use the lower splitter from the old bumper, the other driver has admitted that insurance is the best way to go.

He then asked " Guess we'll have to. We going 50/50?"

Now, I thought that the insurance companies decided the fault of the accident, not either of us. Will they be likely to deem this as a 50/50 accident?
 
not in a month of sundays would that accident ever be 50/50

you werent moving, he drove his car into yours, simples

and you are right its not his call to make unless you both want to handle the settlement off the record as you mentioned in your previous post

What a numpty the guy is. Why even suggest this? Surely if he admits or tries to weasle a 50/50, he's going to loose his excess and no claims regardless?

I'm getting a rear quarter cut out and replaced and sprayed for not much more than that!
 
Witness is a Sales director (the other driver is an internal sales rep), and when we spoke about it (i did not mention acting as a witness at that time) and he said that I had been stationary and applied my handbrake before he even started moving back towards me.

No idea if he will act as a witness. He will probably not want to get involved! I am just hoping the insurance company will see it as cut and dry, and assign blame as required.

Not once did he look back from when he put the car in gear, and then drove into the back of me.

The other driver is now saying he wants to get the quote looked at "by a mate" and will let me know tonight. He is claiming the labour is way too much... Quite how they will know is another matter! lol

This guy sounds like a pillock see the sales director about witnessing it pronto. Get pics of the car park etc and then just hope it all goes right. That in no way is 50/50.
