I want my money back

Ok i'm at that point now, heres a quick update as a refresh, do not reply if you have not read this properly, do not reply if you're looking to cause problems I just want some advice on where I stand getting my money back please!!!!!

I buy a used Toyota Corolla from a Ford main dealer with one month warranty, it needed a battery so it went back for one, it took three days for them to do this, they damaged the car whilst this was being done so it had to go back again for this to be repaired which took another day

It then develops a whining noise, i'm worried about it and due to the advice given to me on here I decided to drop it off with them on a Friday afternoon as the warranty was due to expire. Baring in mind its been a bank holiday I receive a phone call today stating it needs to go to Toyota as they think its the gear box, they cant provide me with a courtesy car and I need a car for work.
I bought a 2005 one owner car with 47K miles because I want a reliable car with a bit of performance and so far the car has been with them for a total of ten days! Basically the car isnt fit for purpose, they cant honour the warranty as they cant diagnose it themselves it has to go to Toyota they shouldnt have sold the car they should have auctioned it or something.

As I dropped the car off in warranty and they are saying it has to go Toyota for further investigation, where do I stand getting my money back? I paid for it on the 30th of July, I dropped it off with them on the 27th of August. Any help on what to do to start the process of getting my cash back in full would be appreciated, its a lot of money to me
 
It will have more than 1 months warranty, a dealer has to give something like 12 months minimum due to the Sale of Goods Act.

Basically, don't panic too much, you've got more leverage than the dealer would like you to think.
 
They have to be given 3 attempts to sort out the fault i believe.

You wont be getting a refund any time soon.
 
If its getting sorted on the warranty I wouldn't get my knickers in too much of a twist about it. Ok its inconvenient, but not as inconvenient as a bill for the supply and fit of a new gearbox.
 
Rather than a refund, why not push for a courtesy car? Sounds like this is causing you problems. If the car didn't have the problems would you still be happy with it?
 
Maybe a trip to Citizens Advice to clarify exactly where you stand?

And if you haven't done so already, get copies of everything in writing, and keep a record of exactly what has happened and when. Easy to forget at times, but its a worthwhile precaution.

If they do end up replacing the gearbox under warranty (It doesn't sound like they've got a leg to stand on with regards to that?) then I'd be happy, you've now got a brand new battery, gearbox etc etc on your second hand car.
 
Ok now i've calmed down after panic posting before here is what I am going to do

Yes I really do like the car I just cant stand having these problems when I bought the car thinking it will be reliable when in fact i've had 12 year old Honda's with less problems and Toyota cant even look at it until well into next week so I need a courtesy car, if they deny me a courtesy car then i'm off to Citizens Advice and trading standards, I didnt spend my money on a car from a dealer to use public transport which is costing me a fortune I understand it takes time to sort but I should be offered a courtesy car

They dont owe you a courtesy car you know.

Just rent a cheapy for a week while they sort yours, save yourself the drama.

Yes they do, I bought a car from them with a warranty I expect that car to work or a like for like courtesy car, if they cant do that I want my money back, what am I supposed to do give them my money and continue my life without a car? No thats just ridiculous, they shouldnt have sold the car if they dont have the expertise to diagnose a fault.

I'm not renting a car either, i'm not rich and I have other commitments I shouldnt have to rent a car when I just bought one!

Yeah? Would that have anything to do with the GM calling me up and saying he has spoken to Toyota, they can get it in Monday and if I can get to them they can give me a courtesy today? If so I like my "rude awakening" I like it a lot. It just means I have to get the train up there to collect but who cares if I get a car out of it and I can get on with my life

Everytime I speak to the GM he sorts me out he seems to be really wanting to get this sorted, its everytime I speak to the people who dont have a clue that I end up getting frustrated and stressed out

When you send your laptop for repair you don't get a courtesy laptop etc...

Getting a refund is next to impossible with used car dealers unless you are seriously mis-sold or something.

They'll much rather fix it than give you money back.

Oh and warranty is crud, for the first 6 months they either have to prove you broke it or fix it - or at least something like that.

Started typing this then got busy at work, point still stands though - they don't have to give you a car, but they have to give you a proper warranty.

Thanks, so am I. However I believe I am owed one and apparently so does the GM of this dealer so I will be collecting it later. I didnt rant I asked about a refund, so if you say "you wont be getting one of those either" my general feeling about that going off this thread and other posts you have made in my threads means I have a pretty damn good chance of getting one! :D

Seriously though, I would actually prefer just to get the car back with the noise gone so I can get on with my life and back to enjoying the car, I do like the car I just recognised the noise as something that should be of a concern in a ticking time bomb sort of way and I did take on board the previous advice of dropping the car off whilst still in warranty which I think has helped me out in the situation

Thanks to all that posted, i'll update for any that might be interested, here to hoping that the courtesy car isnt a new KA again which no doubt it will be :o
 
Nobody here is being narky mate, just stating the fact that you are getting a courtesy car at their discretion, not because you are owed it.

You may feel like you are and perhaps you should be, but its because they decided to offer you one.

I wouldn't moan if it was a KA if I were you, a car is a car.
 
I dont think you can count their damage Ford did as a reliabilty issue that was an accident.

The battery on any car will really only last 3 to 4 years yours did ok at 5 years.

So the only issue really is the gearbox. And if i wanted someone to look at an issue I would rather it be toyota and not ford...lol
 
You should probably read the first line of the original post in the thread

I did, infact I even posted about 5 times in your last thread.

A courtesy car is just that, a courtesy - they don't have to give you one.

I explained the warranty situation and that you do actually have longer and also should have added they need 3 attempts to fix an issue before you can start to even think about asking for your money back.

All valid points - just probably ones you didn't want to hear.
