I've got a battery that's 7 years old, and one that's 8 years old, both fine.

I've seen brand new cars need batterys before they have even been on the road!

It's all to do with how you care for your battery.

And I've had many batteries last only a few years. Recently my Z4 one was on the way out and the car was 3 years old, my previous 325ci had a battery replaced at 4 years old.

unless you have a contract for a replacement car during warranty/service work its purely discretionary and down to the garage/dealer to decide whether you get one or not. They don't owe you one just because you have a warranty.

same goes for any car regardless of cost
 
i've never liked the sound of this car from the moment you posted it.

I was chastised for saying that they were trying to get rid of a lemon quickly. Hate to say i told you so but ...

Anyway be that as it may i do believe you have to give them an oppertunity to repair it. Sales of goods act states the seller has to provide you with a repair or a refund. They get to choose which, not you. So you only get a refund if they cant fix it.

Maybe worth a call to Citizens advice as others have said to be sure however, and see if they have any other advice :)
 
Under the Sale Of Goods Act 1979 (As Amended), any fault with a vehicle within 6 months of purchase is assumed to have been there at point of sale. It is for the dealer to PROVE that this is not the case. After the 6 months the onus is for the buyer to prove the timescale of the fault.

If you wish to reject the vehicle as not fit for purpose you can write a letter and do so. The dealer must have been given a chance to repair first however. Repair does not mean acceptance of the vehicle. If you feel the repair is not acceptable or they do not complete a repair in a satisfactory timescale then you can reject the vehicle.

I recently had to use Sale Of Goods Act to have a wheel bearing replaced on my car after 3 months of ownership. The warranty supplied did not cover it however the selling dealership was forced to cover the cost of parts and labour as they could not prove the fault was not present at point of sale. This was a bit of a battle as they threw a lot of stuff back at me about how it was "Sold as seen" and that they were "not liable if the warranty wouldnt cover". This was all proven to be wrong as a warranty is in addition to your statutory rights under SOGA and not as a replacement. It is a criminal offence for any retailer to restrict your statutory rights as a consumer.

Post in there with what has happened so far with dates and as much detail as possible. The guys really know their stuff and can provide template letters as needed. Always do ALL communication with the dealer via recorded mail (Special Delivery is better) and keep copies of everything.

If the car gets fixed by the garage then I would be happy, if I felt pushy I would ask for the warranty to be extended for another month after all this.

So I picked up the courtesy car up last night and I feel better about the whole situation i'm quite happy to leave the car with them and wait and see what Toyota say, my Corolla isnt a lemon or at least I dont think it is and i've driven it and seen it, there isnt a mark on it, it drives smoothly and pulls very very well, the gear changes are smooth just because its had a battery replaced under warranty and now its having a noise inspected doesnt make it a bad car and the fact that I have confirmation from the GM that if Toyota say that it needs anything it will be covered under the warranty reasures me greatly.
Its only five year old with one owner and full history with the same main Toyota dealer, i've spoken to that dealer and the most work its ever had done is discs and pads.

I'm really looking forward to finding out what the noise is and getting the car back now that i've calmed down a bit and received a courtesy car. Thanks for the advice everyone.

The courtesy car, I still disagree with most to be honest, it will be interesting to know what most dealers policy is with courtesy cars and warranty work as my view (which obviously is just my view) is that you buy a car from a dealer in most cases you are paying a premium for a service and peace of mind that if something goes wrong you can stay on the road during the warranty period, if thats not the case then why not just buy privately or from Honest Johns Cars and buy an AA warranty for £70 for a year!?
The courtesy car is a 2010 Fiesta Diesel, I drove it 12 miles home last night and then to work this morning and the fuel gauge hasnt budged, its not a bad little car, my Brothers girlfriend has one with the same engine and she's really pleased with it, not for me personally I dont like diesels or small hatch backs but for a courtesy car that wont cost me much to fuel it will do perfectly fine

Whilst I do feel for you and your situation, I'd only really expect a courtesy car if I had bought a brand new car and was having problems with it.

I'd expect a courtesy car if I was buying from a franchised dealer. BMW gave me brand new 3 Series courtesy cars free of charge when I had £90 services on my 100,000 mile+ car, let alone if something they had sold me broke!
 
that's a service which you presumably booked, allowing them to arrange the resource, if I was dumping my car at a dealership at short notice I would not expect a courtesy car. Point in case my headlight fell out on the motorway (scary as its the size of a small car) I dropped it off for repair and had to get the tube home, that cost the best part of five grand to fix but I got no courtesy car
