iPhone warranty - my rights?

I have an iPhone 3GS through O2, it's literally a week out of it's year warranty.

In the past month the silent toggle/button has started to fail, it has no physical defects but when in the silent position the phone rarely remains on silent.

My iPhone has a rubber case and screen cover, it's spotless, even after a year.

I took the phone to Apple and they told me it's £139 to fix... I wasn't impressed.

Surely the device has to be fit for purposes i.e. if it's sold with a two year contract and has no signs of abuse/misuse they have an obligation to fix it for me?
 
You could try their phone support. I started having issues with my iPod touch 2 years after buying it and they replaced it no questions asked. It was after they'd pushed an update to it.
 
Kick up a fuss. As long as you can prove that the problem was outside of normal wear and tear, you're protected for two years under EU law and six year under English and Welsh law.
 
It's not reasonable for a £500 phone to fail after a year. Stick to your guns and quote the Sale of Goods Act / mention trading standards.

Well they would be obliged to replace it since it was one of their updates that started caused the problems

You need to have proof that the failure was caused by a fault in the phone from new so the sale of goods act won't help (and the OP would have to pay to get that proof)
