Man imprisoned for not giving police password.

Bit dodgy... nothing would stop me from telling police my password if I was accused of anything (especially paedophilia!). I'd rather they see all the extreme scat granny bestiality space porn than spend jailtime!

what if someone has a vid of their wife doing naughty things with them...would you hand over the encryption key and let the coppers have a look or take a 16 week hit ?

Surely it should be the other way around i mean :p

Get used to the booze before you get a gun you can't handle in the first place.

But anyway, that story is a bit ridiculous... is it any real surprise there is an almost universal contempt for the police and law enforcement when you get stories like that all over?

but think what it's like for the lads they got sent the pics and that's it "possession of child pornography" is now permanently on their record. :(

I still very much doubt the police are interested in this guy because they suspect him of having pictures of 17 year olds though..

You could be right. But, if it turned out that he was harbouring pics of a 17 year old girl friend, the Police would not hesitate to charge him with child pornography offences. Remember, the Police will charge you for whatever they feel they can get a conviction for.

Yeah this is really insane. I just cannot fathom how stupid this law is.

I mean, you can have a bunch of teenagers taking pics of themselves on camera fones, and STILL being charged for child porn offences..

Its beyond a ****ing joke, and makes this country look retarded.

I however, would rather take the 16 week hit obviously, I mean who wouldnt?? (assuming he DID have nasty porn on his PC)

If I change my Hotmail password to poausfpdoaku****90r820****qp9ke02k****erpa0ipa0os and refuse to disclose it it doesn't make me a paedo.

No need. They'd subpoena the account details from Microsoft.

The problem is what the 19 year old is doing, is analogous to a company refusing to satisfy a subpoena.

I love encryption.
One of my passwords is a combination of each of the letters of Arctic Monkeys- Florescent Adolescent (a random verse ;) ) and random numbers/capitals.
Thats just for uni work that i don't want people to copy.
Do most people have one/many encrypted partitions/folders on their computer?

It does just sound like any idiot can ring up anonymously and finger someone as a pedo and even if you aren't found guilty its already too late thanks to the media.

In a perfect world sure. But just because the jury doesn't prosecute you doesn't mean the public won't persecute you. End of the day everyone decides based on what the media publishes and they always bias it to 1 side. Not enough people think outside of that to matter.

This is the big problem with these crimes (and most sex crimes like Rape etc). The public are that inanely thick that the person is guilty before it goes anywhere near a court... A mere sniff of this type of crime and someone's life is ruined.

This is why I advocate anonymity until a guilty verdict is passed for ALL crimes with a sexual element (anonymity remains if not guilty or case dismissed etc)

Why just those crimes ?? Because its only these types of crime (sexual element type) that have this stigma and have this problem IMHO.

It has been proven by real life examples that people's lives are ruined because of accusations of a sexual nature....

I haven't read all through the 432 posts in this thread but is there actual people posting that the lad might actually be innocent of having paedo material?
Give over - he's guilty as hell and will be treated as a nonce inside when they find out why he's there.

Isn't that called prejudging? Sounds like you've decided he's guilty without even knowing the facts, of which there are precious little anyway.

I'd like to think I wouldn't offer up the password either.

As people have said, the Police could get a warrant to search your house, and during the search they find a big safe. So they get a safecracker in to open it, thats fine, that's the law. But if the safecracker can't open it, then what, the Police wouldn't put you in prison for not helping them open it would they?

I could have a laptop HDD, which might contain personal family photos, pics of the missus in the buff, financial documents and records, it could also have my work related stuff which is often confidential proprietry data for clients (and sometimes carries a secret clearance). Responsible people these days are expected and encouraged to safeguard their data, in the age of online identity theft and electronic fraud. I have all my stuff encrypted, I also put all paper copy bills/letters etc through the shredder too.

Sorry but I'm not going to offer up the password, if they want to take the PC away and get their 'safecracker' in then that's fine, just don't expect me to help.

And that's all assuming I'm not guilty of anything, I just value my privacy and that of my family and work clients. If I was guilty of something, I expect I'd be even less keen to help.

Ah guilty until proven innocent.

I forgot that innocent until proven guilty was actually a new concept dmpoole thanks for reminding me.

I wish we had a written constitution. :(

Actually, they can. They don't often need to, but they can.

IMO passwords are the same thing. If I have an encrypted disk, it might have personal family photos, pics of the missus in the buff etc, financial documents and records etc, it could also have my work related stuff which is often confidential proprietry data for clients and carries a secret clearance. I'm not going to offer up the password, if they want to take the PC away and get a 'safecracker' in then that's fine, just don't expect me to help.

You show a lack of knowledge about the law as it is. The only difference between the safe and password examples is that getting a pretty impenetrable password is fairly easy and cheap, where getting an impenetrable safe is not, so the rules forcing disclosure are much more likely to be used.

don't be silly eivl, if you're suspected of being a pedo in the press the Paedofinder General and his lynch mob will burn you at the steak.

Don't be naive now and start saying you need evidence for a conviction.

Although then again dmp is the guy who supoots a 30+ year old police officer trying to force a under age girl to shower in front of him is justified in tazering the girl (with the camera required for all tazer use disabled of course) when she refused.

A written constitution controls the actions of the state, not the thoughts of individuals.

He has remained innocent until proven guilty, that's why he's been jailed for breaking the law requiring disclosure of passwords, and not for possession of kiddie porn.
