as some of you know i have an ongoing claim going after some berk drove into my vectra.

now after lots of to-ing and fro-ing the other parties insurer admitted 100% liability with my solicitors yesterday. so all well, or so it seemed

i spent all morning today trying to explain to my solicitors that i will end up out of pocket for increased insurance for the next few years, they seemed somewhat confused by this until i managed to speak to a partner in the firm, both claim handler and claims manager didnt have a clue it seems as they both were insisting i would never see a rise and it must be due to my claim still being active on the motor insurance database. I eventually managed to convince them by running 2 quotes and e-mailing the difference off using a completely fake name in a random address to illustrate my point.

anyways. the partner has advised that i have no hope in hell of claiming increased premiums back as a non insured loss unless i can prove an actual loss. IE i need to be able to offer written proof from the insurance company that my premium would be £xxx cheaper if i hadnt been involved in a claim as quotes from online wouldnt stand up in court it seems

now with no renewal due for the Taxi for at least 7 months and Adrian flux adopting the sensible opinion that a NON FAULT claim will not increase a premium i'm at a loss as of how to demonstrate this. and how the sky van driving pleb has suddendly jacked up the cost of my impending mid life crisis and s2000 ownership plans

my argument would be quotes from online sites showing that the cheapest quote i can obtain on a s2000 today would be £350 more with a non fault claim listed. but seemingly this is unnaceptable. Can anyone suggest a way to prove that i will be bum raped by insurance companies that would be accepted in court?

as far as i can see i'm getting screwed as follows

stigma of being classed a less safe driver by certain companies
reduced choice of insurers(some refuse to quote)
and obviously dearer prices with certain(namely cheapest) insurance firms

help please guys

There is no way you'll get this accepted in court.

Find a different insurer.

sound advice but why should i have to endure the extra legwork of trying to get a decent quote? i'm suffering for something that has been deemed not to be my fault. and unfortunately the companies that use this getout of non fault claimants being riskier are funnily enough the ones offering the cheapest quotes hence i'm ending up out of pocket

Your insurer sucks, deal with it.

The sooner you get used to this idea the sooner you can stop stressing because it's not going to happen.

Insurers would rather insure people who can get out of the way when somebody comes crashing towards them. The IAM once said that something ridiculous like 75% of non fault accidents could be avoided by the victim if they had better anticipation skills? It's therefore not suprising that some insurers feel people make their own luck.

oh not my insurer (flux are fine with the non fault claim and didnt stick a penny on my price for the LCR renewal) i'm looking at mainstream insurers for the planned purchase of a midlife crisis s2000. and obviously i have taxi insurance due in feb which i havent investigated the increase of yet

So you're trying to claim for the increased insurance rise with a non fault claim versus a claim free quote, on a car you don't even own yet?

Jesus, get a grip, there's no way you're going to be able to claim that.
