Hi

I hardly post in motors, however I do realise there is a knowledgeable bunch of people in here to offer advice etc.

Long story short, I was involved in an accident 2 years ago. The third party said we could call it £800 and 'forget about it', however my car had damage and as I was fully comp decided to take the loss of no claims on the chin and handle it through i insurance... I believe I even asked for people opinions on here.

Anyway, I ended up admiting fault because, well it was my fault! Insurance company paid out, I got my car repaired, my insurance went up which is fair enough. 2 years later i.e. today I recieved a letter through the post because the third party is taking me to the small claims court for damage to his car, legal expenses etc.

Obviously the first thing I did was to call my insurance company who said they have the claim on record, they have paid out a to the third party for his vehicle, along with hire car and (probably) fabricated injury claims and I should contact the person who settled my claim on monday (past 5pm when I called).

So a few question: Is this a common thing for people to do i.e. seeking further money even after a pay out from insurance? Are people normally succesful with such claims? Obviously I will contact my insurance again on Monday but what is the best way to proceed with such a matter?

DO NOT CONTACT THE THIRD PARTY.

Forward all correspondance to your insurance company and forget about it :)

Whatever happens next is not your problem and wont affect you.

I had the same thing when I had an accident - 3rd party tried claiming some time after original claim. I just forwarded onto insurers and forgot about it.

Scan / Photocopy it first though, insurance companies are good at 'losing' things.

Thanks for the advice guys. I will do eactly as you suggest; after photocopying the correpondence it will be forwarded straight to my insurance company.

This

Your insurance company should pick this up.

I get a letter informing me that i was being talken to the small claims court because my insurance comapny were arguing with the person i hit over their hire car costs. The accident damage was under £700 but they were claiming for over £2500 in hire car costs - something that my insurance co was refusing to pay and disputing

I just sent the small claims court letter to my insurance co who dealt with it. Never did hear what figure they settled on.

How does this work when you get insurance quotes? What figure do you put for the cost of your claim?

I just put 3k in

I dont think it has to be to the exact £, just a rough guess of the cost. You never usually see the full details of costing, i only know because i got court papers through with everything laid out for the court !

Just a scumbag trying his luck, coming up to christmas, things are tight, he needs money. Give it to the insurance company and move on.
