BBC Stole my video!

Hmmmm

Id say your on to plumbs because the imagery from the game is copyright to the publisher so the BBC in turn have fair use as you have used fair use puting on youtube.

My cat video ended up on a Sky TV program like you've been framed, they contacted me though for permission first.

I don't think you understand the term "fair use".

Basically, the BBC needed permission from either the author (the OP) or youtube (a licensee with redistribution rights). They obviously haven't got it from the OP, so unless youtube gave permission, your video was being used without permission, contrary to copyright legislation.

Are videos uploaded to YouTube not property of YouTube?

No, like I said, they are just a licensee. The author still retains copyright ownership.

Lizard men control the Bbc and maybe youtube.

Contact youtube just for the lulz to see if the bbc did request permission to use your clip. If not then I dont know what you could really do but you could change your signature to " BBC ***** nicked my video"

Message BBC for the lolz. See what they say.

Edit: Wasn't there someone else here filmed by them at a LAN party?

I thought you were Legally allowed to use short clips of Copyrighted Music and Video without any permission but they had to be under a certain duration (10 Sec or less IIRC)?

YouTube has a license to use your work, the BBC does not. You still retain the copyright to your work when you upload it to YouTube. The internet is not the free-for-all that some people think it is.

Check out this case. Invoice them for £600. :)

But surely that guy had some sort of protection against use of his photos (like warning on his website etc). I do not really know anything about the legalities on this subject. Is just creating the photo/video enough to make unauthorised usage against the rules?

The UK has no fair use exemption.

Content uploaded to YouTube is free for all - ie why RudeTube doesn't get sued thirty times a week.

No it's not. Rudetube most likly got permission from Youtube (who has the right to sanction it's redistribution)

Like I said above, youtube could have given the permission to redistribute the content to the BBC.

It was a pretty good video, no wonder BBC used it. I'd be glad. some cool story you've got :D.

cheers bro, check out my latest i40 Lan video if you liked that one ;)

I'll contact youtube and see if they gave permission.

Burnsy, where do I stand if the video was obtained elsewhere. Such as a direct download or say the multiplay fileplay servers? Guess it would depend on their file upload regulations?

Copyright is opt-out rather than opt-in. Unless you specify that the image can be used under something like the Creative Commons license, it's assumed that you retain all rights to the video.

Well just in case the BBC ever find this thread, I am outraged at the blatant disregard of my intellectual property rights!

lol

Just watched the i40 video, brilliant mate; throughly enjoyable ten minutes.
Did you do all the editing? Do you get paid for putting that together? Pro job.
