When can you involve Trading Standards?

So the only thing they've done wrong is take your money for items that aren't in stock yet ??

They've offered you a refund or to wait. There's absolutely nothing wrong. Stop overreacting and take the refund if you're that worried.

Yeah that's something different again - eg person spots a TV in Tesco labelled as 49.99 instead of 499.99, Tesco just turn around and say "oops, that's not the right price." No money changes hands, Tesco aren't obliged to sell the TV.


The situation here is like me saying

"I have a new Ferrari for sale, chaps. I'll sell it to you for £9,999. The RRP is £100,000, good deal, eh?

"I'll take your money now, and give you an order # and an invoice. Please note the order isn't complete until your receive your Ferrari."

Then I hang on to your money until such a time as you realise I'm not going to send you a Ferrari, and ask for your money back.

That's just poor customer service though

A mate of mine was in a similar situation a few years ago when buying a sound system , he was told the easiest solution would be to cancel the order and get a refund, which he did.
A month later (after already receiving his cash back) a sound system also arrived which he kept quiet about.
 
Write a letter and demand satisfaction. Nothings really legal till its written down afiak

I had this once with something small and cheap, they asked me 3 months later if I wanted it still and I said yep please and it was sent np. They didnt charge me till dispatch though

Speak to your credit card people if you think you are right, they have the leverage

He can't demand anything except his money back, a business is under no legal obligation to satisfy a customer except to make sure they work to the sales of goods act.
 
Im just saying without written agreements and discussion it doesnt count. They could say they'll give him a bar of gold over the phone but it wouldnt mean much so he might as well write a letter whatever happens

basically until they despatch the goods at the price advertised and the price you have agreed to there is no contract.

They have done the right thing in offering you the choice. It happens all the time, there is nothing you can do unless they have actually already debited your card (I may have missed this bit). Otherwise take the new price or the offer to cancel.

The card was debited immediately on making the order (debit, not cc).
 
Gadget Show invested something like this before. However it was for a store not an online retailer. In simple terms they must supply the product if they take your money, it had that price tag and it still stands, and as you are waiting for that product, they should supply you with it, given the fact they took the money from your bank account. Only thing would be to either keep hassling them like your doing or basically try and find a store somewhere near you and go and knag them.

Most online stores have it in their t&c's that until the item has been dispatched the contract is not complete and they can reneg on the sale

this is to stop simple mistakes holding them to a contract which could cost them a lot of money if many people have managed to find out about the mistake and order the item as previously done with Kodak iirc, and other companies

Mhmm does differ slightly from the store policies so i agree, as for when a store advertises it at a certain price, and you pay for that product at that price, the store cannot ask for that product back with a refund of money. I think thats where i got it wrong as you dont read t&c's when buying stuff from a store, atleast i dont think you do.

Maybe by subliminal messaging :)
