Insurance claim dispute

She caved in my front passenger side wheels/door

she says i was indicating to go left (i wasnt) therefore that is why she drove into me.

Well she can't really dispute it if she drove into your passenger door can she? If you were indicating left and she pulled out then the damage would be your front/her side, not her front/your side?
 
I wll get roasted for this but you should have made a claim for injuries so you dont end up out of pocket. From my own experiance and knowing the details of a few collisons with friends and famility i know all too well that usually you end up out of pocket through no fault of your own, and its now pretty much accepted that you make a claim to top it up so you end up roughly back where you started.

Insurance is getting daft now and its all about lying and cheating your way out of it. The decent honest people get royally screwed over ( the sort who wont make a whiplash claim as its only a bit sore ).

My ex's claim took nearly 9 months to sort out in the end, luckily her car was still drivable.
 
I have made a claim against her for the imjuries sustained and time lost off work.

I do have photos of both cars at the scene of the accident but Helphire don't seem to want these at the moment.

The ladies excuse for crashing into me, as a few of you have already pointed out doesn't hold true. As mentioned if i was indicating to turn left into the lane 15/20metres before where she was waiting why on earth did she drive into the side of me?? By her logic that means she either did it on purpose or was not watching.

Helphire said they believe she is trying to delay everything in an attempt to frustrate and somehow try and go for 50:50 liability but i will refuse and fight this if this decision is reached (god knows how though!)

Maybe someone else will flame you but I agree with you entirely.

You never get a proper valuation, then they add a load of bull**** fees, then they cancel the remaining 9 months of your policy with no refund (and deducting any outstanding payments), meaning you can't just transfer it onto another car and carry on.

Even with the default 1 grand whiplash payment on top you still lose out.


As for the OP, as everyone else has said, even if he was signalling left, it's still the other person's fault. The OP could have been intending to pull over at the side of the road just after the junction.
 
As my driving instructer always said... an indicator is just that.... an indication of what someone may do, not what they WILL do.
 
I don't see why on earth she'd really care if it goes 50:50 or not. She will still lose her no claims, her policy will still get loaded and nothing comes out of her own pocket. The only person it effects is you.

Seeing as she must know she was at fault, I find this utterly infuriating.

She probably doesn't realise all of this. She thinks if she argues it she might not get stung as bad.
 
Utterly infuriated is how i feel. It's just making me so mad. I'm stuck here, victim of an accident blatantly not my fault, my cars been taken away, value agreed, all i want is a cheque so i can buy my new car dammit!

I think it is deeper than this. People hate being 'at fault' or 'to blame', and it going 50-50 makes them feel better, as they can tell themselves that someone else was to blame as well.

I just wish people would apply some intelligence to these "instincts".
 
Well finally common sense has prevailed. This morning i received a call from the solicotor offering me an out of court settlement if i stop having physio and he said the 3rd party has at last admitted liability.

A huge relief! :)
 
Seems weird.

You might actually need the physio and if you don't have it you could have serious problems later in life.

I've just never heard of someone admitting fault and offering you money under the provision that you stop getting treated!

Glad shes grown some balls though.

You don't want to end up with me and have lifelong chronic back and neck pain that's basically untreatable as a result of some muppet who can't drive.

Is it private physio through insurance, or NHS physio?

out of court, i thought it was going through the insurance companies?

as mentioned above, not continuing to have physio seems a strange offer.
 
Sorry my fault, not very clear.

Her insurance have contacted my legal aid and offered an amount (which i rejected) to settle now on but if i accept i will have to stop the physio which i have 3 weeks left of (no chance, i'm still in constant pain,some days worse than others) and give up the medical assessment i am due at the end of the month.

I will finish the physio and have the assessment as i generally don't get pain like this so i want it sorted so i can get back to the gym and the football team i play/manage.

Edit - I am undergoing private physio through insurance.
 
Seems like they want to get everything brushed under the carpet before you have this assessment and find out your really screwed and then they may need to pay out more.

She's admitted liability just wait for all your physio and assessments and they'll have to pay up whatever your due.
 
What was the settlement? Was this supposed to be for the car, or just damages/injury? Does it cover the cost of the car?

I'd be inclined to look at that as an admission of guilt and stick to your guns. What have helphire said regarding this? If they have admitted liability then you may be able to get your courtesy car back?
 
If you are in need of the physio then keep going. They have admitted liability, so keep it normal and get another car from helphire
