"i am willing to work more than 48hours"

Hi. has anyone come across the above phrase in a contract of employment? never seen that phrase before.

basically it gives you two options. one saying you are willing and the other you are not(if required).

It is for a typical 9-5 job. any of you guys ever agreed to work over 48 hours? sounds a bit extreme? can an employer deny the agreement if you cant work over 48 hours per week?
 
The Work Time Directive says that you can't work more than 48 in any week. Employees can opt out of this scheme so that if you want to cram in loads of overtime one week and end up doing 50 hours then your company isn't doing anything wrong because you've agreed to it.

You don't have to sign it and some people don't. It's up to you - are you likely to want to do a lot of overtime at any point?

Is it a job where you CAN do more than 48 hours? If it's a 9-5 job, is it say an office job where the office is closed outside of these hours? Seems a strange thing to get you to sign if it is.

EDIT: Also, have you got the job yet? Just bear in mind that someone who is willing to do lots of overtime might be a more appealing candidate.
 
Yep just the EU opt out, just because you sign it doesn't mean you have to. Best to just sign it if you want to do lots of overtime.
 
Watch out. If you sign it and they start giving you 50+ hour rotas, you wont be able to reject it. Ask them what a "normal" working week is like and see what they say.

It's a catch 22 sometimes. If you sign it you can get stuck with massive rotas and have little to say about it; but if you don't they may not keep you on if they think they can find someone who's content.
 
One thing to remember is even if you opt out it's entirely up to you if you work more than 48 hours a week (averaged over around 18 weeks).
 
Lol, 48 hours extreme? I'm not trying to big myself up or anything but I'm in the RAF and have had to spend 4 months in places such as afghan doing 84 hour weeks on several occasions. Aside from that my usual week is usually at least 50 hours so don't take your 9 - 5 job with the off chance of 8 hours overtime for granted :p

Only if they give us silly deadlines or people in our team are slacking off big time. its a software developer role and yea i got the job. just need to sign the deed i.e contract of employment
 
I'll be signing something similar if I get a job on Aldis' graduate recruitment scheme, 60 to 100 hours a week are fairly standard apparently....

No, it doesn't. It says you 'cannot be forced to work more than 48 hours a week on average - this is normally averaged over 17 weeks. You can work more than 48 hours in one week, as long as the average over 17 weeks is less than 48 hours per week.'

You can, however, waive this right, if you sign up to do so. That's what this contract line is...
 
My last job asked me to sign this when i first joined, which I signed since it was my first main job.

3 years later when I was very unhappy with being overworked and not paid for it, i handed in a letter to stop them being able to get me working more than this. This was just near the end of my job too. I now get paid for the overtime I do! so its no longer a problem at my current job. :)
 
I was asked to sign this in my current job. I couldn't see any benefit to me so I didn't sign it.
 
we signed the waiver to accomodate our on-call system. don't think it said about the 48hours, it did say that we were agreeing to an 8 hour rest between working days, so this means it's ok for us to work a 112 hour week (7 days) :/ then another 5 days of the same until we get a day off.

Take it for granted? It's not like anyone forced you to join the RAF, you could've got a 9-5 job if you wanted to :p
