Hope the resident legal eagles can help.

I went skiing with some friends arranged by the ski club at their ex-university. As part of the amount we had to pay a damage deposit. After the holiday we've all been told that we have to pay £10 extra each for membership of the university ski club, which has been automatically deducted from the damage deposit. No mention was made of this before the trip when we booked, or in the terms and conditions as far as I can see.

Am I right in thinking that since they made no mention of this charge before paying for the holiday (or in the terms and conditions received after paying) that in legal terms they cannot add this extra charge?

Sure, it's only ten quid. The amount doesn't change the fact that they're effectively stealing it though does it?

I'd just like to know whether they are acting illegally, and if so, under what... Sales of Goods Act?

I'd say it's worth pursuing. It may only be £10 from him but taken from a large group of people it's going to be a lot of money. If they really are taking it improperly then they shouldn't be allowed to get away with it, and I doubt this is the first time it's happened.

Haha. Seeing as it was booked through an ex university ski club, Im sure you enjoyed some form of discounts for the trip, as most university's are able to enjoy said discounts, which Im sure amounted to more than a tenner! In which case, just let it go, and be thankful you got to enjoy the holiday!

I'm not going to be taking them to court or anything, but things like this annoy me, and I'd like to stop them doing it if possible by telling them what law if any they are breaking in doing so.

did you sign anything when you gave a deposit ?

say you want your deposit back because it was a deposit not a membership fee. the membership fee is a whole different matter and both them and you should be dealing with it separately

I didn't sign anything - it was paid for online. There wasn't any mention of needing to be a member or pay for membership.
