Legal heads help! Can O2 charge me?

Didn't have this problem when cancelling with O2 recently. They cancelled it fine and my last bill even has credit. Which reminds me, need to ring them up and get it back!

Same here, I was on a 24 month contract which started at the end of January 2009, at the end of december 2010 I gave my 30 days notice and requested PAC, transferred to my new contract 2 days before my 24 months was over and they even credited me for those 2 days. Cancelling my o2 contract was the easiest thing I've ever had to deal with o2 for.
 
Sounds unreasonable under the Unfair Terms in Consumer Contracts Regulations 1999. Charging without providing a service is ridiculous regardless of what the t&c say.

They are providing a service. If the number is ported, they can issue you a temporary sim/number for the duration of the contract.

it can be a little tricky depending on circumstance, as the contract will stipulate that it will continue unless you cancel, which on the surface, is fair enough.
however, cancelations, especialy by phone, quite often are ignored or forgotten. on purpose, or through incompetance? who knows, but this is the issue.

always cancel in writing, via email or recorded letter.

secondly, if you do end up like the op, then your defence is very clear:

a) the contract expired
b) they cannot proove you are utilising the service, if you are not using it.
c) you have a simmilar contract with a competitor which you are now using.
d) you informed them you were not going to continue.
e) you stopped payment at the the end of contract.

This. Just because something is in a contract, it doesn't make it enforceable by law.
 
Okay thanks for the help everyone. I've decided to pay my February bill (rightly so) and blocked direct debit for the March bill.

Why? 3 reasons:

It's the 25th month.
I won't benefit at all (no service)
And it's well beyond the 30 day notice, I cancelled it around 40 days before the stated date of the March bill.
 
Blocking the direct debit won't end well.

You need 30 days notice to cancel, which will be clearly stated in the T&C's. You cancelled on the 12th, which will take you through to the 14th of March. They will almost certainly only charge you up to the 14th of March, even though the billing date is the 17th. Just because you're being billed on the 17th doesn't mean you're being charged up to then.
 
I was in the exact same situation as you when i was with Orange. Although they reimbursed me for three weeks that i didn't use the service.
 
I made the same mistake with my last contract, never even thought about it till I got a bill through my door. :(

Still, it is in the contract, so fair enough like.

I made the same mistake with Orange, but enough kicking off on the phone and they agreed to waive the final bill. Although I did tell them the previous month, they were babbling on about doing it before the billing date or something.

I had already cancelled the DD so they couldn't get it without suing me anyway.
