If you had an independent witness that there would be a case winner, however I doubt you would count due to your relationship with one of the parties, but would be worth checking...
 
In short the solicitor I spoke with said the situation is very messy!

He went on to say that he doesnt deal with such situations. I'll forward it onto a different sol if you want.
