Legal action againt my ISP

Hi everybody,

I have a problem with my current ISP. The case was ongoing since July last year. The problem I have is that I am being constantly disconnected. My ISP is "trying" to find the problem, but they blame BT and BT's "computer" says "no" problem.

I'm not going to describe my anger.... Yes I could change my ISP, but that won't resolve this situation. Also it is not cheap at all.

I am thinking about taking a legal action against them, but I'm not sure what legal grounds to use. Their ToS only says about loosing service for more than 48hours at which point I can demand a compensation. Because I haven't lost the connection for more than 48 hours, but if I add all those disconnections together it will be much more than 48 hours.

Is there anything in UK like lawyers that could help me in this matter? Not private ones? How much does it cost? How does it work?

Does anybody have any experience with this sort of case?

The best you can hope for is early release from your contract, you'll get nothing in the way of compensation and I doubt any lawyer would bother taking your case on.

Have you considered the possibility that it's your local wiring (i.e. your responsibility) that's the problem?

You won't win legally, just get yourself in debt. Is anyone else in the village with them suffering the same issue?

Only real way to voice your concern is to do it with your custom, and change ISP.

I am on a 1 month contract and I could easily quit, but like I said I haven't got much choice here where I live.

Regarding my equipment, it's 100% fine. I've had 5 different routers, I even went and bought a brand new router just to find out the same problem...
BT engineer came around my house to check everything and he said it's ok. Though he didn't check the cables from the exchange...
 
Without further information, I would assume that your cause of action would be their failure to comply with their express obligatation to provide you with the service specified.

But really, you are far better off just changing ISPs. I would write a letter explaining you plan to terminate and report them to their regulatory body if they don't fix things pronto.
 
So basically you're an argumentative git who wants to make a big fuss over nothing, instead of a simple move ?

Yes I am argumentative especially when I pay £42 a month! I wasn't looking for your opinion, but advice.

Your the only one suffering, they aren't. Just move isp. Can't believe you've put up with it for so long.

Also are you on wireless, or is it defo the internet dropping out. Have you tried finding the master phone socket in teh house and plugging it in there.
The problem could well be internal wiring, if you move ISP and it happens at least you know that there is a fualt somewhere.

To successfully claim you would need to prove you had incurred financial loss, which you can't. Give it up and move ISP.

Alternatively, find a local lawyer who specialises in litigation and pay them £200 an hour.

Surely he is losing out financially if he is paying for a service that he doesn't receive?

I don't know if CAB can help but maybe it's worth a try. If all else fails then as suggested, just move isp.

Want some advice, get off your high horse. You might be argumentative with too much time on your hands but lets face it, a nation wide internet provider has terms, conditions and legal policies that you agreed on when you joined, you have no chance mate.

Come back to reality and just move providers.
