That's a sure sign of a faulty graphics card. If it was PSU the faliures would all be under load.

Not really conclusive in my opinion... why under load? If the PSU is faulty or can't handle it it can fail at idle...

However from reading your issues I don't think it's the PSU either, but you will need a better PSU sooner or later so it won't do any harm.
 
I've tried various types of drivers. Windows, ran the disk, latest from sapphire, latest from AMD and older versions from AMD. I haven't tried putting the GPU in a different slot but just assumed it should work in any

Yes, but you rule out the PCI-E your card is currently inserted into isn't dodgy, i.e. it isn't a motherboard issue...

Do you have another access to another computer to test your card?
 
I've just got my pc back from the shop where they tested another 6970 and it worked perfect. The 6970 I own seems to fail whilst gaming but only on CoD4 and not on other games such as Brink and Shift 2, they also ran a benchmark on the GPU and it didn't fail but due to the fault not appearing with a different 6970 in the machine I'm just going to RMA mine and hope for the best. Massive thanks to everyone that helped me it is appreciated.
